Questo Manuale nasce dall’esperienza, ormai ultraventennale, di docenza universitaria dei suoi Autori. Ma nasce, forse ancor di più, dal sentimento di amicizia che li lega e dalla comune sensibilità che i medesimi hanno scoperto negli anni di avere maturato nello studio e nell’insegnamento del diritto pubblico. Esso rappresenta, dunque, innanzitutto il tentativo di “fare ordine” e di “accordare i suoni” in una pluralità di esperienze, di studi, di idee e di convincimenti che si spera possano essere d’aiuto agli studenti e alle studentesse che intraprendono un percorso di formazione universitaria nel campo delle scienze giuridiche, politiche ed economiche, quindi a coloro che frequentano innanzitutto, ma non solo, le scuole o le facoltà di giurisprudenza, scienze politiche ed economia del nostro sistema universitario. Proprio da tale unità d’intenti è nata, innanzitutto, la scelta per il titolo, Istituzioni di diritto pubblico, che richiama la gloriosa tradizione della giuspubblicistica italiana, ma che a chi scrive pare giustificata oggi, non meno di ieri, dalla necessità di ribadire l’unitarietà del metodo nello studio del diritto pubblico. A fronte della sempre maggiore complessità che caratterizza gli ordinamenti pluralistici contemporanei, infatti, acquisire fin dai primi passi della formazione giuridica la consapevolezza della matrice storicamente e concettualmente unitaria del diritto pubblico italiano, e per molti versi europeo, rappresenta la maniera più efficace per comprendere in chiave unitaria quei contenuti essenziali dell’ordinamento costituzionale che costituiscono l’imprescindibile sfondo la cui conoscenza è necessaria per poter affrontare le difficili questioni poste non solo dai vari rami dell’or¬dinamento medesimo, ma anche dai fenomeni che trasversalmente li attraversano, come, per fare alcuni esempi, l’erompere del diritto internazionale e dell’Unione europea, la crisi dell’unità e dell’autonomia della comunità politica, la rimodulazione del rapporto tra diritto pubblico e privato, la crescente delegittimazione dei pubblici poteri, l’affermarsi dei poteri privati, l’impatto della scienza e della tecnica. Tutti questi fenomeni, uniti al ricordato carattere pluralistico – e, quindi, inevitabilmente frammentato – degli ordinamenti contemporanei, rendono sempre più difficile individuare quali sono i soggetti che decidono i contenuti che la convivenza civile e politica tra gli individui assume in un determinato momento storico e in un dato territorio per rispondere alle esigenze, sempre mutevoli, dei tempi. Così come è sempre meno immediato comprendere quali sono le forme – e, quindi, le garanzie, innanzitutto democratiche – con cui queste decisioni vengono prese e quali responsabilità esse generano in capo a chi le prende. Per questo motivo, nel condiviso convincimento che la ricerca delle risposte a queste domande possa essere un utile viatico per lo studio del diritto pubblico e delle questioni essenziali che esso pone, la trattazione degli argomenti affrontati nei vari Capitoli è accompagnata dal ricorrere di una domanda: Chi decide? Tale interrogativo, infatti, si è affermato come ineludibile nello studio di tutte le principali tematiche del diritto pubblico. Chi decide nei rapporti internazionali? Chi decide all’interno dell’Unione europea e quale sovranità rimane agli Stati membri? E “dentro” l’ordinamento repubblicano: Chi decide nei rapporti tra Stato, Regioni ed autonomie locali? Chi decide tra Parlamento e Governo nelle dinamiche della forma di governo parlamentare? Chi decide sul significato da attribuire alle norme dell’ordinamento nelle fitte relazioni tra amministrazione, giudici, Corte costituzionale e Parlamento?

Understanding and exercising the right to freedom of association, in a modern sense, is a relatively new phenomenon in China. The reform of ‘old’ social organizations and the emergence of new, privately-initiated, non-profit organizations only began to occur in the 1980s, and such organizations continued to expand throughout the 1990s. Within a short period these new organizations have become a vibrant force in Chinese society. This unique volume – the first book in English to offer systematic and critical research in this field - is the outcome of a three-year research project on the Legal Aspects of Social Organisations in China. The main aim of the project was to encourage Chinese researchers to deepen their knowledge and understanding of the current status of social organizations in China, and to allow them to explore possible ways of creating a friendly legal environment conducive to the exercise of the right to freedom of association. The relationship between Western democracies and Islam, rarely entirely comfortable, has in recent years become increasingly tense. A growing immigrant population and worries about cultural and political assimilation—exacerbated by terrorist attacks in the United States, Europe, and around the world—have provoked reams of commentary from all parts of the political spectrum, a frustrating majority of it hyperbolic or even hysterical. In The Fear of Barbarians, the celebrated intellectual Tzvetan Todorov offers a corrective: a reasoned and often highly personal analysis of the problem, rooted in Enlightenment values yet open to the claims of cultural difference. Drawing on history, anthropology, and politics, and bringing to bear examples ranging from the murder of Theo van Gogh to the French ban on headscarves, Todorov argues that the West must overcome its fear of Islam if it is to avoid betraying the values it claims to protect. True freedom, Todorov explains, requires us to strike a delicate balance between protecting and imposing cultural values, acknowledging the primacy of the law, and yet strenuously protecting minority views that do not interfere with its aims.
