Il concetto di lavoro sostenibile appare la chiave di volta per rispondere alle sfide poste dai cambiamenti demografici in corso che hanno sì consentito alle persone di vivere più a lungo e meglio ma, al contempo, hanno aumentato lo squilibrio tra popolazione attiva e inattiva ed alterato le dinamiche del mercato del lavoro, indebolendo ulteriormente la sostenibilità dei sistemi di Welfare. Per questo motivo, appare necessario intraprendere azioni coraggiose e politiche “trasformative”, orientate verso lo sviluppo del capitale umano dei giovani, la formazione e ricollocazione degli adulti, il mantenimento, nel mercato del lavoro, dei cosiddetti anziani sfruttandone ancora le competenze ma anche verso adeguate politiche di conciliazione vita-lavoro. Il lavoro sostenibile potrebbe dunque svolgere un ruolo cruciale nel mercato del lavoro, andando a collegare differenti politiche in un’agenda globale, con un obiettivo a lungo termine: quello di adeguare il lavoro al lavoratore, in modo che rimanga in salute e attivo quanto più a lungo possibile. Un percorso che andrebbe però accompagnato dall’impegno delle imprese di assorbire e praticare la cultura della sostenibilità: attraverso cioè la creazione di valore economico socialmente e ambientalmente sostenibile, le imprese potranno contribuire all’affermarsi di un modello di sviluppo sostenibile, basato sui concetti di equità inter e intra-generazionale.

This is the conference book for the XIV European Regional Congress of the International Society for Labour and Social Security Law, dedicated to the interactions between social law and other areas of law. In recent years, labour law and social security law have been subject to various reforms and developments. Social law is however not an isolated domain but rather interacts with other fields, often even functioning as a guide or giving direction to those lost at sea. In other words: serving as a lighthouse. The key aspect addressed in this book is the existence of a connection between social law sensu stricto (labour law and social security law) and other areas of law. Pursuing an inter- and multidisciplinary approach, it gathers contributions on topical and challenging issues in four broad areas: 1. Basic and fundamental principles of European social law 2. The future in the light of the past 3. The impact of regionalisation 4. Enforcement in social law In turn, various developments can be identified in connection with these topics: the emergence of social criminal law is creating new overlaps between social and criminal law; the growing number of administrative law sanctions offers new insights into and connections between social security law and administrative law; the increasing similarity of employment in the public and private sectors raises questions about the applicability of administrative law in labour law relations; the relation between the ECHR and the articles of the Constitution opens up new perspectives on the constitutional interpretation of freedoms and on the interaction between human rights, constitutional law and social law; and lastly, there is a growing influence of EU law and international treaty law (concerning trade) on social law. Can we, by looking at these developments, draw certain conclusions at a different and innovative level? Although the existential threat of climate change has at last been generally acknowledged, its influence on the labour market and the regulation of labour relations remains ambivalent at best. This supremely important volume, with contributions by thirteen prominent labour law practitioners and academics, shows how labour law not only can but absolutely must assume a greater role in the debate on the climate crisis and move towards a new eco-friendly labour paradigm. Relegato fino poco tempo fa a un ambito sperimentale, il lavoro da remoto ha avuto un’improvvisa e massiccia diffusione a seguito della pandemia per contrastare l’aumento dei contagi da Covid-19 e permettere il proseguimento dell’attività economica. L’impatto della diffusione dello smart working sul mercato del lavoro, seppur con caratteristiche del tutto emergenziali, è stato dirompente e ha consentito modalità di svolgimento della prestazione lavorativa un tempo inimmaginabili. Per la prima volta la rottura dell’unità di spazio, tempo e azione apre prospettive nuove: il lavoro può essere svolto anche lontano dalla sede del datore di lavoro. È qui che si innesta il fenomeno del South working come prospettiva dalla quale valutare le implicazioni di quello che è probabilmente l’effetto più importante e duraturo della pandemia dal punto di vista socio-spaziale: la diffusione del lavoro a distanza. Per decenni sempre più giovani sono emigrati dalle aree marginalizzate, dal Sud e dalle aree interne, in cerca di opportunità di studio o di lavoro nei grandi centri urbani del Centro-nord, ma oggi la componente digitale e tecnologica permette un approccio diverso al lavoro a distanza. Lavorare in maniera «agile» produce effetti positivi per tutte le parti coinvolte: aumenta la produttività di lavoratori e aziende, favorisce una più alta qualità della vita percepita e costituisce un’occasione di rilancio per i territori. I contributi di questo volume sono frutto di un’elaborazione critica iniziata durante la prima fase della pandemia e alimentata in seguito da incontri con lavoratori, istituzioni, imprese, organizzazioni pubbliche e private. Tutti questi attori hanno arricchito il dibattito allo scopo di ripensare il futuro del lavoro da remoto, mettendo al centro le persone, i territori, le aziende e ridisegnando una geografia diffusa del lavoro che sia non solo agile ma soprattutto coesa.
