This book explores the history of the international order in the eighteenth and nineteenth century through a new study of Emer de Vattel’s Droit des gens (1758). Drawing on unpublished sources from European archives and libraries, the book offers an in-depth account of the reception of Vattel’s chief work. Vattel’s focus on the myth of good government became a strong argument for republicanism, the survival of small states, drafting constitutions and reform projects and fighting everyday battles for freedom in different geographical, linguistic and social contexts. The book complicates the picture of Vattel’s enduring success and usefulness, showing too how the work was published and translated to criticize and denounce the dangerousness of these ideas. In doing so, it opens up new avenues of research beyond histories of international law, political and economic thought.

I saggi raccolti in questo volume abbozzano una storia costituzionale del Regno di Napoli nel decisivo momento di passaggio dall’antico al nuovo regime, inquadrandola nella storia rivoluzionaria e costituzionale europea. Dal pensiero di Jean-Jacques Rousseau e dai modelli costituzionali nati dalla rivoluzione francese l’analisi passa al Mezzogiorno e dall’elaborazione del progetto costituzionale della Repubblica Napoletana del 1799 si porta all’ultima fase del regno murattiano con il suo epigono costituzionale. Il progetto costituzionale della Repubblica Napoletana, elaborato principalmente da Francesco Mario Pagano, rappresentò il più deciso tentativo da parte delle cosiddette Repubbliche sorelle di discostarsi dal modello – per ragioni politiche assolutamente vincolante – della costituzione francese dell’anno III. Un tentativo che si richiamava all’esigenza di offrire al regno di Napoli una costituzione per quanto possibile nazionale. Un altro momento importante si ebbe con la concessione della Costituzione di Baiona da parte di Giuseppe Bonaparte: trascurata dalla storiografia perché “inattuata” e illiberale la prima costituzione formale dei Napoletani ebbe invece un posto importante nella storia del Regno perché – nonostante isuoi limiti – riuscì a identificarsi con le istanze autonomistiche e libertarie dei patrioti. Ad essa e allo scialbo costituzionalismo napoleonico gli inglesi contrapposero nel 1812 due modelli più avanzati: la costituzione di Cadice e la Costituzione di Palermo, la prima a carattere democratico e la seconda liberale. Nel 1808, con le due costituzioni di Baiona che Napoleone fu costretto a concedere a Spagnoli e Napoletani dopo la disinvolta conquista della Spagna, si innescò dunque una sorta di “guerra delle costituzioni” e in quel contesto nacque e si diffuse rapidamente, proprio dal regno di Napoli, la carboneria che tanta importanza ha avuto nella storia del nostro Risorgimento: il volume riprende e approfondisce la tesi storiografica della fondazione della setta da parte di Pierre-Joseph Briot, giacobino in Franca-Contea, membro del Consiglio dei Cinquecento e, durante il decennio francese, intendente in Abruzzo citeriore e in Calabria citeriore.
