Il primato del diritto dell'Unione Europea negli ordinamenti nazionali: quo vadis?: Il principio del primato del diritto dell'Unione europea su quello nazionale sancisce la capacità, propria dell'ordinamento giuridico euro-unitario e assente in tutti gli altri sistemi sovranazionali o internazionali, di impedire l'applicazione di una disposizione del diritto interno degli Stati membri qualora questa, nel corso di un giudizio, si palesi in contrasto con una norma europea ad essa anteriore o successiva. Da mera regola non scritta, nel corso dei decenni esso ha assunto uno spessore sempre maggiore, sino a diventare tanto importante da legarsi fatalmente allo stesso processo di integrazione europea: risultato, questo, cui si è giunti soprattutto grazie al dialogo - non sempre pacifico - fra Corte di Giustizia e Corti costituzionali nazionali. Queste ultime, infatti, spesso si sono duramente opposte alla piena accettazione del principio in parola, ponendovi condizioni e limiti a protezione di valori costituzionali considerati intangibili: specialmente negli ultimi anni, tale tendenza ha peraltro assunto caratteri così incisivi da far supporre che l'integrazione europea sia giunta al suo "massimo limite sopportabile". Primato, integrazione e loro limiti sono dunque i concetti chiave del presente lavoro, il quale, attraverso un'analisi del percorso giurisprudenziale compiuto dalla Corte di Giustizia nell'arco dell'intera vita dell'Unione, si propone di dimostrare come principio del primato ed effettività del diritto europeo vanno di pari passo con la volontà dimostrata dagli Stati membri - incarnati, in questa sede, dalle loro Corti costituzionali - di proseguire
