Il volume raccoglie 40 pronunce che rappresentano un valido strumento di lettura e comprensione degli istituti del processo amministrativo, nel loro continuo divenire, per gli studiosi e gli operatori del diritto. È rivolto a studenti universitari e post-universitari, che possono utilizzarlo sia in modo autonomo, eleggendolo a manuale di riferimento per la preparazione di concorsi ed esami, sia in abbinamento ad un testo più tradizionale di giustizia amministrativa. Ogni caso viene introdotto da un QUADRO GENERALE che tende precisamente a collocare la singola pronuncia nel contesto dei principi e delle regole che lo riguardano, anche con rinvio ad essenziali riferimenti di dottrina. Seguono, quindi, LA VICENDA, vale a dire la descrizione dei fatti da cui trae origine la controversia e l’indicazione della NORMATIVA DI RIFERIMENTO, consentendo al lettore di reperire facilmente le fonti da esaminare. L’analisi proposta in questo volume ripercorre fedelmente l’impianto del codice del processo amministrativo, di cui vuole essere specchio e, al tempo stesso, banco di prova. Per questo stesso motivo, i casi selezionati sono in massima parte recenti, preferibilmente tratti da pronunce delle Corti superiori, ma non sempre (o non necessariamente) famosi; l’approccio alle sentenze prese in esame è sistematico, in molti casi critico, e sempre teso a sottolineare le lacune e i vuoti lasciati aperti dalla recente codificazione. Nella parte concernente LA SENTENZA, poi, viene riportato un estratto della pronuncia del giudice (Consiglio di Stato, TAR, Cassazione, Corte costitu- zionale) che risolve la questione. Infine, IL COMMENTO tende a fornire qualche elemento per collocare la pronuncia nel contesto più generale della giurisprudenza, segnalando se l’orientamento adottato si presenti, rispetto ai precedenti, pacifico o quanto meno prevalente, o se sia all’oppo- sto minoritario o, ancora, se si tratti di un caso privo di precedenti.
