Vengono altresì in rilievo i temi che hanno caratterizzato la giurisprudenza sull’accertamento dei fatti negli ultimi tre lustri e che ancora oggi non sembrano aver trovato soluzioni appaganti. Si pensi, ad es., allo standard di prova del “più probabile che non”, ormai divenuto diritto vivente, di cui devono essere chiariti i presupposti applicativi. O, ancora, all’accertamento del nesso di causalità materiale, in particolare ove richieda l’applicazione di una legge scientifica. Il volume intende offrire al lettore una guida in un importante settore dell’esperienza giuridica in cui il legislatore ha correttamente lasciato al giudice una grande discrezionalità, ed è la stessa giurisprudenza a stabilire in concreto, con i connessi e inevitabili rischi, i limiti della suddetta discrezionalità.

This book develops a logical analysis of dialogue in which two or more parties attempt to advance their own interests. It includes a classification of the major types of dialogues and a discussion of several important informal fallacies. The authors define the concept of commitment in a way that makes it useful in evaluating arguments. In traditional logic, a proposition is either true or false, and that is the end of it. In this new framework, an arguer can be held to his or her commitments in some cases, but in other cases, he or she can retract them without violating any rule of the dialogue. Commitment in Dialogue studies the conditions under which commitments should be held or may be retracted within an argument.

Histories of the Napoleonic period are almost exclusively biographies of the man, or political-military accounts of his wars. But such wars were only the first stage in a far more ambitious programme; the establishment of a rational state which would force the pace of modernising society. Through an examination of the experiences of French domination, Napoleon's Integration of Europe explores the implications of such a project for France and its relationship with the rest of Europe. It examines the problems of ruling a progressively expanding empire, as seen through the eyes of a trained corps of bureaucrates who were convinced that their scientific methods would enable them to understand and govern the mechanisms of society. However it also looks at the populations subjected to French rule, at the nature of their resistance and adaptation to the principles of the Napoleonic project. This book is the first overall comparative study of Europe in the Napoleonic years. It is a study not only of an early exercise in imperialism, but of the conflict that is aroused between the rationalising tendencies of the modern state and the spatial and cultural heterogeneity of individual societies. As well as a history of France, it is also a history of Italy, Germany, Belgium, Holland, Switzerland, Poland and Spain at a crucial moment in the history of each nation state.
