Questo volume costituisce l’esito di una ricerca che l’autore ha dedicato al problema di come il sesso sia stato, storicamente, reso intelligibile, interpretato e messo in discorso principalmente attraverso il diritto e la sua tecnologia. Il “sesso” viene qui indagato nel suo significato di rapporto sessuale, di ciò che rimanda ad un certo tipo di atto, a qualcosa che si fa. Ma come distinguere, su questo piano, il fatto dell’accoppiamento, della congiunzione carnale, da quello che chiamiamo il “buon” sesso, ossia qualcosa in cui non ci sarebbe posto per la violenza, per la sopraffazione? Su che cosa si basa la differenza tra sesso e violenza, che sembrerebbe essere, per chiunque, immediata e ovvia? Per poter rispondere a tali domande, il libro muove dalla convinzione che ciò che chiamiamo “rapporto sessuale” non è qualcosa che esiste, nella cultura occidentale, se non in quanto inestricabilmente connesso al diritto, al suo lessico ed alla sua tecnologia. È il diritto, infatti, il dispositivo che ha permesso di separare quanto, sul piano empirico, non lo è affatto, ossia il semplice fatto “naturale” dell’accoppiamento (che può essere certamente violento, può avvenire anche nel caso in cui una parte non sia consenziente, ecc.) da ciò che chiamiamo rapporto sessuale (che come tale esclude, de iure, la violenza). Dalla discussione medievale sul cosiddetto jus in corpus ai più tardi tentativi di definizione del commercium sexuale da parte di un autore come Kant, dalle pagine hegeliane sul matrimonio sino alla odierna teoria del sesso come “contratto”, l’autore discute, anche attraverso il continuo confronto con la psicoanalisi freudiana e lacaniana, le strategie concettuali e le aporie che hanno segnato la giuridicizzazione del rapporto sessuale – ossia le tecniche attraverso cui il legame tra i due sessi è stato prodotto e pensato. E ciò nella convinzione che non sarà possibile sviluppare le contraddizioni che, oggi, attraversano il discorso sulla sessualità, se non si saprà ritrovarle e ripercorrerle all’interno della logica giuridica che ne è alla base.
