Territorial autonomy in Spain has reached a crossroads. After over thirty years of development, the consensus regarding its appropriateness has started to crumble. The transformation project embodied by the reform of Statute of Catalonia (2006) has failed to achieve its most significant demands. Although the concept of Spain as a Federation is disputed -more within the country than beyond-, the evolution of the Spanish system needs to follow a markedly federalist path. In this perspective, reference models assume critical importance. This edition gathers the works of a broad group of European, American and Spanish experts who analyse the present-day challenges of their respective systems. Italian Constitutional Justice in Global Context is the first book ever published in English to provide an international examination of the Italian Constitutional Court (ItCC), offering a comprehensive analysis of its principal lines of jurisprudence, historical origins, organization, procedures, and its current engagement with transnational European law. The ItCC represents one of the strongest and most successful examples of constitutional judicial review, and is distinctive in its structure, institutional dimensions, and well-developed jurisprudence. Moreover, the ItCC has developed a distinctive voice among global constitutional actors in its adjudication of a broad range of topics from fundamental rights and liberties to the allocations of governmental power and regionalism. Nevertheless, in global constitutional dialog, the voice of the ItCC has been almost entirely absent due to a relative lack of both English translations of its decisions and of focused scholarly commentary in English. This book describes the Italian Style in global constitutional adjudication, and aims to elevate Italian constitutional jurisprudence to an active participant role in global constitutional discourse. Al consolidamento delle istituzioni e degli strumenti di cooperazione internazionale nel campo della tutela dei diritti umani si è accompagnato un ampio dibattito sui vincoli imposti alla sovranità degli Stati, del quale sono protagoniste le istanze giurisdizionali create nel contesto delle Convenzioni internazionali e le Corti costituzionali. Il presente volume offre i risultati di una riflessione condotta da giuristi di diversa formazione, che dà atto di una sostanziale convergenza della giurisprudenza internazionale e interna nella interpretazione delle norme sui diritti umani, anche se in diverse pronunce delle Corti costituzionali viene ribadito il principio della preminenza della Costituzione e dell’identità nazionale sugli obblighi derivanti dalle Convenzioni. Con riferimento al contesto europeo, numerose relazioni si soffermano sul ruolo della Corte di giustizia dell’Unione europea nell’assicurare la tutela dei diritti dell’uomo, operando un confronto rispetto alla giurisprudenza della Corte di Strasburgo e auspicando un migliore coordinamento a livello istituzionale. Nel pieno del dibattito politico-giuridico sullo statuto dell’Unione Europea, sul tipo di entità che vuole essere e sul tipo di valori su cui intende fondarsi, diviene attuale il rilancio dello studio della Carta di Nizza, la Carta dei Diritti fondamentali dell’Unione Europea, proclamata a Nizza nel 2001 ed entrata in vigore con il Trattato di Lisbona nel 2009. In particolare diviene fondamentale lo studio del primo valore su cui la Carta dei Diritti Fondamentali, parte integrante della Costituzione europea, si fonda, il valore della dignità umana. Il libro svolge un’analisi concettuale di questo principio-valore, con la lucidità e il rigore che una disamina a distanza (un’analisi dopo la "Carta di Nizza") rende possibili. Il suo contributo nuovo è un’indagine di tutte le trame e le gerarchie possibili, che il valore della dignità umana intrattiene con gli altri valori informanti gli ordinamenti giuridici, scandagliando diverse posizioni in gioco, ma avanzando anche una proposta. A fondamento dell’ordinamento giuridico europeo, l’autrice propone una concezione della dignità umana come norma suprema, non bilanciabile, dal contenuto “minimo”, che amplia la concezione kantiana di dignità umana. Tale ampliamento va nella direzione di un ripensamento della dignità umana in chiave fenomenologica, che, diversamente da più diffuse posizioni giusnaturalistiche, non rinuncia all’autonomia dell’individuo. Tra le fonti d’ispirazione dell’autrice si annoverano, fra gli altri, il pensiero di Jeanne Hersch, filosofa del ’900, connessa in maniera significativa alla Dichiarazione Universale dei Diritti dell’uomo del 1948, di cui rinvenne la radice in un’“esigenza assoluta”, nonché il pensiero di Max Scheler, filosofo per eccellenza dell’individualità essenziale.
