This book explores the relationship between the law and pervasive and persistent reasonable disagreement about justice. It reveals the central moral function and creative force of reasonable disagreement in and about the law and shows why and how lawyers and legal philosophers should take reasonable conflict more seriously. Even though the law should be regarded as the primary mode of settlement of our moral conflicts,it can, and should, also be the object and the forum of further moral conflicts. There is more to the rule of law than convergence and determinacy and it is important therefore to question the importance of agreement in law and politics. By addressing in detail issues pertaining to the nature and sources of disagreement, its extent and significance, as well as the procedural, institutional and substantive responses to disagreement in the law and their legitimacy, this book suggests the value of a comprehensive approach to thinking about conflict, which until recently has been analysed in a compartmentalized way. It aims to provide a fully-fledged political morality of conflict by drawing on the analysis of topical jurisprudential questions in the new light of disagreement. Developing such a global theory of disagreement in the law should be read in the context of the broader effort of reconstructing a complete account of democratic law-making in pluralistic societies. Four major women's autobiographies of the twentieth century are discussed together here for the first time. Valérie Baisnée reinterprets the autobiographical writing of Simone De Beauvoir, Maya Angelou, Janet Frame and Marguerite Duras, finding some striking similarities in these women's resistance to a conservative order. Deploying a variety of theoretical approaches, from linguistic to Marxist, Baisnée endeavours to break the restrictive patterns of author-centred studies, to go beyond simple oppositions between truth and fiction, and to dispense with the facile interpretation of these texts as confessional. For Valérie Baisnée, Autobiography is meant to represent not the true but the official version of a life, signed by the author herself and revered as hagiography by the public. ... Instead of analysing women's autobiographies as confessional, it is possible to see this mode of discourse as a means to counteract the effect of exposure of women's private lives. By revealing their past, however painful it may be, the four autobiographers studied in this book also enhance their present strength, and therefore underline the political nature of the autobiography.

L’originalité de cet ouvrage est de montrer un paradoxe. D’une part, grâce à la mesure du temps, la démocratie a pu être créée ; sans l’isonomie – la même mesure du temps pour toutes les ten-dances politiques – la démocratie n’aurait pas pu se construire sans le paramètre essentiel qui consiste à penser le vivre en-semble sur le temps long. D’autre part, cette même mesure du temps, à notre époque contemporaine est devenue hypertro-phique, cela fait peur. Plus on mesure ses actes, plus cela pèse sur l’individu social. Évaluer et mesurer ses performances sont ce qui le fatigue le plus à l’heure actuelle. Ce paradoxe nous amène à nous interroger sur ce moment contemporain particulier qui met en scène la dimension du temps dans sa nécessité et sa contradiction.
