A proposal that immigrants in the United States should be offered a path to legalized status. The Obama administration promises to take on comprehensive immigration reform in 2010, setting policymakers to work on legislation that might give the approximately eleven million undocumented immigrants currently living in the United States a path to legalization of status. Commentators have been quick to observe that any such proposal will face intense opposition. Few issues have so divided the country in recent years as immigration. Immigrants and the Right to Stay brings the debate into the realm of public reason. Political theorist Joseph Carens argues that although states have a right to control their borders, the right to deport those who violate immigration laws is not absolute. With time, immigrants develop a moral claim to stay. Emphasizing the moral importance of social membership, and drawing on principles widely recognized in liberal democracies, Carens calls for a rolling amnesty that gives unauthorized migrants a path to regularize their status once they have been settled for a significant period of time. After Carens makes his case, six experts from across the political spectrum respond. Some protest that he goes too far; others say he does not go far enough in protecting the rights of migrants. Several raise competing moral claims and others help us understand how the immigration problem became so large. Carens agrees that no moral claim is absolute, and that, on any complex public issue, principled debate involves weighing competing concerns. But for him the balance falls clearly on the side of amnesty.

A central question in the debate on justice in immigration is whether immigrants have a right to stay; this book argues that liberal-democratic receiving states should also grant migrants a right not to stay. This claim runs against the presumption that migrants always desire to move on a permanent basis and intend to forge a completely new life in the country of destination. From this perspective, temporary migration is always a second-best option for migrants, engendered by the closed and often punitive migration policies of receiving countries. This book's innovative focus on the right not to stay is prompted instead by the realization that increasing numbers of migrants throughout the world conceive and plan their migratory experience as circumscribed in time and instrumental to goals and projects that they will pursue once back in their country of origin. These temporary migration projects are worthy of being accommodated by the receiving states as much as the migratory plans of those who resolve or aim to immigrate on a permanent basis. Accommodating them entails setting up the appropriate welfare measures and programs in the host country and, through bi-lateral agreements, in the country of return. This is especially important in view of the fact that very often the migrants who engage in temporary migration projects find themselves in a condition of high vulnerability and risk. The "right not to stay" advocated in this book is a positive and substantive right to see one's project of temporary migration-and-return protected and accommodated by institutions.

Even though there is a lack of specific legal provisions directly applicable to this social category, the general ones, such as the Charter of Fundamental Rights of the European Union, the International Covenant on Economic, Social and Political Rights, also concern undocumented migrants. They are analyzed from general to particular taking into consideration broad terms such as “all”, ‘every”, “everyone”, which include the specific category of undocumented migrants. The existent case law, although characterized by scarcity because of the migrants’ fear of being deported when lodging claims in courts, emphasizes the fact that this social category also has rights and these rights are recognized and defended in national and European courts. The obstacles in accessing fundamental rights are also analyzed. The practical implications are taken into consideration. Ideas to improve the exercise of fundamental rights to work and healthcare by irregular migrants are suggested at the end of every chapter. Being human beings, they have the right to social protection regardless of their status.

On May 17, 2010, four undocumented students occupied the Arizona office of Senator John McCain. Across the country a flurry of occupations, hunger strikes, demonstrations, and marches followed, calling for support of the DREAM Act that would allow these young people the legal right to stay in the United States. The highly public, confrontational nature of these actions marked a sharp departure from more subdued, anonymous forms of activism of years past. The DREAMers provides the first investigation of the youth movement that has transformed the national immigration debate, from its start in the early 2000s through the present day. Walter Nicholls draws on interviews, news stories, and firsthand encounters with activists to highlight the strategies and claims that have created this now-powerful voice in American politics. Facing high levels of anti-immigrant sentiment across the country, undocumented youths sought to increase support for their cause and change the terms of debate by arguing for their unique position—as culturally integrated, long term residents and most importantly as "American" youth sharing in core American values. Since 2010 undocumented activists have increasingly claimed their own space in the public sphere, asserting a right to recognition—a right to have rights.
