Policing Undocumented Migrants explores the extraordinarily routine, powerful, and above all lawful practices engaged in policing status within state territory. This book reveals how the everyday violence of migration law is activated by making people ‘illegal’. It explains how undocumented migrants are marginalised through the broad discretion underpinning existing frameworks of legal responsibility for migration policing. Drawing on interviews with people with lived experience of undocumented status within Australia, perspectives from advocates, detailed analysis of legislation, case law and policy, this book provides an in-depth account of the experiences and legal regulation of undocumented migrants within Australia. Case studies of street policing, immigration raids, transitions in legal status such as release from immigration detention, and character based visa determination challenge conventional binaries in migration analysis between the citizen and non-citizen and between lawful and unlawful status. For two decades veteran photojournalist David Bacon has documented the connections between labor, migration, and the global economy. In Illegal People Bacon explores the human side of globalization, exposing the many ways it uproots people in Latin America and Asia, driving them to migrate. At the same time, U.S. immigration policy makes the labor of those displaced people a crime in the United States. Illegal People explains why our national policy produces even more displacement, more migration, more immigration raids, and a more divided, polarized society. Through interviews and on-the-spot reporting from both impoverished communities abroad and American immigrant workplaces and neighborhoods, Bacon shows how the United States' trade and economic policy abroad, in seeking to create a favorable investment climate for large corporations, creates conditions to displace communities and set migration into motion. Trade policy and immigration are intimately linked, Bacon argues, and are, in fact, elements of a single economic system. In particular, he analyzes NAFTA's corporate tilt as a cause of displacement and migration from Mexico and shows how criminalizing immigrant labor benefits employers. For example, Bacon explains that, pre-NAFTA, Oaxacan corn farmers received subsidies for their crops. State-owned CONASUPO markets turned the corn into tortillas and sold them, along with milk and other basic foodstuffs, at low, subsidized prices in cities. Post-NAFTA, several things happened: the Mexican government was forced to end its subsidies for corn, which meant that farmers couldn't afford to produce it; the CONASUPO system was dissolved; and cheap U.S. corn flooded the Mexican market, driving the price of corn sharply down. Because Oaxacan farming families can't sell enough corn to buy food and supplies, many thousands migrate every year, making the perilous journey over the border into the United States only to be labeled "illegal" and to find that working itself has become, for them, a crime. Bacon powerfully traces the development of illegal status back to slavery and shows the human cost of treating the indispensable labor of millions of migrants-and the migrants themselves-as illegal. Illegal People argues for a sea change in the way we think, debate, and legislate around issues of migration and globalization, making a compelling case for why we need to consider immigration and migration from a globalized human rights perspective.

How the immigration battle plays out in America, from curriculum disputes to federal raids to the civil rights activism of young “Dreamers.” Illegal immigration continues to roil American politics. The right-wing media stir up panic over “anchor babies,” job stealing, welfare dependence, bilingualism, al-Qaeda terrorists disguised as Latinos, even a conspiracy by Latinos to “retake” the Southwest. State and local governments have passed more than 300 laws that attempt to restrict undocumented immigrants' access to hospitals, schools, food stamps, and driver's licenses. Federal immigration authorities stage factory raids that result in arrests, deportations, and broken families—and leave owners scrambling to fill suddenly open jobs. The DREAM Act, which would grant permanent residency to high school graduates brought here as minors, is described as “amnesty.” And yet polls show that a majority of Americans support some kind of path to citizenship for those here illegally. What is going on? In this book, John Tirman shows how the resistance to immigration in America is more cultural than political. Although cloaked in language about jobs and secure borders, the cultural resistance to immigration expresses a fear that immigrants are changing the dominant white, Protestant, “real American” culture. Tirman describes the “raid mentality” of our response to immigration, which seeks violent solutions for a social phenomenon. He considers the culture clash over Chicano ethnic studies in Tucson, examines the consequences of an immigration raid in New Bedford, and explores the civil rights activism of young “Dreamers.” The current “round them up, deport them, militarize the border” approach, Tirman shows, solves nothing.
