The protection of intellectual property in the People's Republic of China has been of great importance at least since the opening of the market in 1978. Although the first efforts to protect the rights of individuals in the field of copyright were made as early as the Qing Dynasty, it took until the 1990s before a copyright law was finally implemented. While the law is already quite advanced in the books, effective enforcement of rights has faced and continues to face many hurdles. Due to that and also to take account of technological progress and further developments at the international level, China's copyright law has been undergoing a reform process since 2012 which resulted in the 2020 Amendment of the Chinese Copyright Law that takes effect on 1 June 2021. This work focuses on the legal historical development of copyright law in the People's Republic of China with the aim of understanding the current reform of the Copyright Law and the problems China has faced and is facing. This open-access book addresses latest Sino-German results of the joint research efforts within Major Water Program of the Chinese Government supported by German research funding. The Major Water Program aims at the restoration of polluted water environments and sustainable management of water resources in China. The joint BMBF-CLIENT project SINOWATER deals with three most significant and strongest polluted Chinese waters, the river Liao and the Dian-lake as well as Tai-lake in the area of the metropolises Shenyang, Kunming and Suzhou, respectively. The project was conducted by the Research Institute for Water and Waste Management at RWTH Aachen (FiW) e.V., Bavarian State Ministry of the Environment and Consumer Protection, Technical University of Munich, RWTH Aachen University, German and Chinese companies (Martin Membrane Systems AG, Steinhardt GmbH Wassertechnik, GuHong, JT-elektronik, bluemetric, Huawang Water, EVU Group, Atemis GmbH, i+f process GmbH) in close cooperation with Chinese Academy of Environmental Sciences, Tongji University, and the Dianchi Lake Management Authorities. Overall, the joint Sino-German research project SINOWATER provided solutions for the improvement of the water quality in the mentioned water bodies as well as development and optimization of Good Water Governance. These objectives could be achieved through the implementation of innovative German water technologies and the optimization of water management elements in the fields of industrial and municipal wastewater treatment as well as river and shallow lake management.

Vor allem sollen Definition und Umfang von Immobilien genau definiert werden. In der chinesischen Literatur werden der Begriff von Immobilien in erster Linie im Vergleich zu den beweglichen Sachen definiert. Zwischen den beweglichen und unbeweglichen Sachen gibt es folgende Unterschiede: Erstens sind die Sachen nach dem physikalischen Standard einzuordnen, und zwar, ob die Sachen physikalisch frei bewegbar sind. Nach diesem Standard beziehen die Immobilien sich darauf, dass die Position der Gegenstände nicht verändert werden könne, oder deren Wert, Wesen und Form nach der Umstellung verändert werden könnten; während die physikalische Stellung von den beweglichen Sachen einfach verändert werden könne, oder deren Wert, Wesen und Form von der Bewegung nicht beeinflusst werden könnten. Zweitens zählten mit den Werten als Maßstab die für eine lange Zeit existierenden Sachen, die größere Erlöse bringen könnten, zu den Immobilien; im Vergleich dazu sei der Wert von den beweglichen Sachen relativ niedriger, weil sie nicht lange verwahrt werden könnten. Nach dem verfahrensrechtlichen Maßstab unterschieden sich die Immobilien von den beweglichen Sachen dadurch, ob die Rechte von den Sachen einzutragen seien. Demgemäß seien die Immobilien entsprechend den gesetzlichen Bestimmungen durch rechtliches Verfahren einzutragen. Zwar wurde der Begriff von Immobilien schon in 1986 erlassenen Allgemeinen Grundsätzen des Zivilrechts der VR China (Abk. AGZ) erwähnt, aber kaum deutlich definiert. Gamäß § 186 der Stellungnahme des Obersten Volksgerichts über mehrere Fragen bezüglich der Umsetzung der AGZ (Abk. Umsetzung der AGZ) gehören Land, Gebäude und andere auf dem Land stehende Bauwerke sowie feste Zusatzanlagen der Bauwerke zu den Immobilien. Der Begriff von Immobilien, den der Gesetzgeber im Sachenrecht mehrmals erwähnt hat, wird leider nicht deutlich definiert.
