This working paper presents the status of forest tenure in contemporary Indonesia; it explores how forest tenure reforms emerge and the options for formal approaches to securing customary rights in Indonesia. It also presents an overview and analysis of Indonesia's legal and institutional framework for tenure reform. Forest tenure reforms in Indonesia have evolved through dynamic, interactive, collaborative processes that have involved both State and non-State institutions. Both the processes and the products (such as policies and programs) of forest tenure reforms in Indonesia, such as the 1999 reforms that resulted in social forestry schemes, have not been effectively implemented in Indonesia due to the: onerous process of obtaining a permit; lack of direction and motivation of staff within implementing agencies in supporting social forestry; limited capacity and resources among both communities and implementing agencies to comply with the technical requirements to process the permit; and macro-level economic prioritization of extractive activities that concentrate benefits in the corporate sector. Moreover, women and marginal members of indigenous peoples and local communities have been largely left out. However, recent developments such as Constitutional Court Ruling No. 35/2012 defined land and forests within customary territories as private entities, and not State land and forests. Furthermore, recent government initiatives for recognizing existing agroforestry practices within kawasan hutan by granting land title or bringing them under social forestry schemes are important developments that can help to resolve conflicts. Finally, the government's ambitious target of bringing 12.7 million ha of State forest area under community management, deregulation of some of the steps for obtaining a social forestry permit and the involvement of non-State actors in tenure reform processes have the potential to further strengthen local people's rights and security over land and forests, if properly supported and implemented.

Key messages The future of forest tenure security for local forest dependent communities in Lampung province is linked to the effective implementation of social forestry (SF) programs, which granted communities management rights to state forests. If SF schemes are implementated effectively, the tenure rights of forest dependent communities will be assured.Participatory prospective analysis (PPA) by an expert group consisting of governmental and nongovernmental organization representatives, identified six key driving forces that will influence SF implementation in the next 10 years. These include:- the dynamics of SF regulations including regulation of forest product businesses- economic options created by communities to improve livelihoods- community tenure rights to forest resources- budgetary support from regional government- human resources capacities of implementating agents such as the Province Forestry Office, Forest Management Unit (FMU) and NGOs- the clarity of stakeholder roles including community awareness.The different scenarios, which describe plausible conditions of forest tenure reform implementation in Lampung, range from persistence of the status quo, where communities continue to have partial rights to state forests, to variations that include full ownership rights, complete withdrawal of community rights to forests, and the privileging of economic interests over environmental sustainability.The desired scenarios are associated with adequate budget allocations including dedicated budgets for implementation. Lack of coordination is a disadvantage and is characteristic of undesired scenarios. The capacity of implementing agents is also a key factor, especially their capacity to work with communities and to support them. Functional forest-based enterprises to support community livelihoods, which in turn provide strong incentives for sustainable forest management, are important. Taken together, the scenarios suggest that devolving SF implementation to the lowest unit, the FMU, is the best option. However, this should be accompanied by community empowerment, the allocation of adequate budgets and support and cooperation among all involved actors.The expert group developed an action plan for enhancing SF scheme implementation over the next 10 years. Strategies include enhancing budgetary support to the regional government, strengthening the role of the FMU, strengthening community tenure rights and enhancing local livelihoods. Key actions include supporting cross-sectoral coordination, developing PES systems to boost regional government revenues, increasing legal literacy at community level and community/participatory mapping of resources.The action plan will be integrated into Lampung Provincial Government's forestry development program and will guide Lampung's Social Forestry Working Group.Overall, the PPA method reveals that the implementation of SF programs is multi-faceted, capturing the diverse concerns and roles of different stakeholders. It also enhances the capacity of stakeholders to jointly analyse problems, to anticipate the future and to design current actions to mitigate future problems or enhance the likelihood of meeting desired objectives.

Following the enactment of Decentralization Laws No. 22/1999 and No. 25/1999, and several Forestry Ministry's decrees issued in 1999, district governments throughout Indonesia were given a greater authority to formulate local regulations over forest resources. The District Government of Tanjung Jabung Barat in Jambi took this opportunity to introduce three policies regarding small-scale timber utilization and forestry revenues. This report begins with a normative legal analysis and basic evaluation of these policies. It then explores the district's policy-making processes and mechanisms for implementing district regulations and describes the functions and roles of the relevant district institutions. The report then fi gures out the players in the process and how they infl uence the policy Abstract agenda and at the end provides an analysis of the impacts of decentralized forest policies on local people, focusing on small-scale timber concession licences. This work is the result of research meant to generate information and analysis to facilitate negotiated recommendations for improving forest policies and policy making processes by supporting public input to shape the decentralized forestry policy agenda for the district, and help develop a forest management model oriented to increased prosperity and justice for local people. The research calls for the District to draft a new regulation on public participation in district policy making, with the policy objective of building consensus and synergy amongst local stakeholders by using appropriate public involvement mechanisms.

They can provide a sustainable supply of wood resources to meet the increasing demands of wood processing industries, rather than escalating pressure on natural forests reserved for conservation. Income from plantation forests can address the economic marginalisation of forest dependent people. Over the last three decades, three strategies have been put into practice to stimulate the development of both large-scale and small-scale plantation forestry in Indonesia: farm forestry, community forestry and community-company partnership. The success, however, has been limited. This paper reviews experience of these strategies in Indonesia, and considers this in the context of criteria and indicators for sustainable plantation development suggested in the literature. It then develops an analytical framework to assess whether a new policy proposed in Indonesia, “the People Plantation Forest” (PPF) policy, is likely to stimulate community-based tree growing activities. Our analysis suggests that out of six elements identified in the framework, local institutional and capacity building, along with production technology and market access improvement are aspects that PPF might cope well and thus likely to encourage independent community-based tree growing activities. Whereas other elements such land and crop tenure security together with complex licensing and marketing bureaucracy are not dealt with thoroughly and consequently might still be major stumbling blocks in that regard. For PPF to stimulate independent community-based tree growing, it requires commitment of government agencies across different jurisdictions to coordinate on the provision of technical, financial and regulatory support to minimise constraints in tree growing. Tenure security issue can be minimised through a more participatory approach for land demarcation and mapping; any initiatives conducted by members of community for such purpose should be accommodated. While complex licensing and marketing bureaucracy might be eased off through the creation of a simpler and more integrated procedure. This commitment of support, though, needs to be maintained in the long run given the nature of tree-growing ventures.

This study examines the preliminary impacts of Indonesia’s decentralization process on the administration and management of forest resources in Ketapang District, West Kalimantan. The case study is based on field work carried out in mid-2000, using a rapid appraisal methodology. The report covers the impacts of decentralization in three areas, in particular: customary adat communities, oil palm and rubber plantations, and conservation issues related to Gunung Palang National Park. In each of these areas, the authors examine struggles among competing interest groups that have arisen under decentralization. The study finds that with the shift of administrative authority to the district level, the district government in Ketapang tool measures to generate local sources of revenues by issuing large numbers of small-scale timber extraction permits and to ‘legalize’ the transport of timber that had otherwise been harvested illegally. The study also finds that the very limited flow of formal revenues from the Gunung Palang National Park to the district government has encouraged an escalation of illegal logging within the park’s boundaries. It is recommended that the Ketapang district government become more involved in administering the national park to ensure that economic interests of both the district government and local communities are accomodated in the park’s management.

Industrial timber plantations are controversial in many parts of the world. Indonesia provides an interesting case study, with its history of conflicts over land use and current ambitions for plantation expansion. This study investigated perceived impacts of plantations on nearby rural populations. A survey was conducted of 606 respondents across three islands (Java, Borneo and Sumatra), three tree species (acacia, teak and pine) and three end uses (pulpwood, timber production and resin production). In addition, a Q-method analysis was conducted at a site with an established pulpwood plantation in order to identify significantly diverse perceptions of the plantation among villagers. The methods were combined to arrive at a representative view of these perceptions and expectations. Results illustrate a diversity of viewpoints among villagers, with perceptions varying from general dissatisfaction to enthusiasm. Perceptions of pine and teak plantations tend to differ from acacia pulpwood plantations. For pine and teak, respondents reported a higher number and greater variety of benefits and services, higher number of perceived positive impacts in general, a better environmental record, and more opportunities to use plantation land and products for rural livelihoods. These results contrast with the heavy focus around acacia plantations on economic development and infrastructure. Hence, acacia plantations enjoy some level of recognition for opening up remote areas and providing infrastructure and services that are traditionally the responsibility of the state. Data were disaggregated by gender to enable further analysis, and offer a general indication that plantation development has not affected women more negatively than men. Our analysis leads to several clear directions for the improvement of plantation management. The role of the state must be clarified and potentially reinforced, except if the burden of development, including that of infrastructure, is to remain the responsibility of companies. Lessons can be drawn from the teak and pine cases in Java as to the performance of institutions that act as intermediaries between companies and people. Contributions by communities should be facilitated early in the planning stages, and this should apply in particular to land claims, to the organization of the labor force (including the privileged form of work contract), to the spatial distribution of the plantation in order to leave aside areas of local value, and to options for land sharing, as this is a major vehicle for fruitful coexistence.

This case study discusses decentralisation and forest management in Kapuas district, Central Kalimantan, focusing specifically on the impact of these administrative reforms on timber concessions operating there. It is based on field research carried out during June and July 2000. The study is based on interviews with government officials, forestry department staff, university researchers, NGO workers and the employees of timber workers in the provincial capital, Palangkaraya, and the district capital, Kuala Kapuas. Research was also carried out in Gunung Mas in the headwaters of the Kahayan River and further interviews were conducted with businessmen, sub-district government officials and lower level forestry staff, community leaders and local villagers. This document provides: (1) Essential background regarding the geography, economy and history of forestry in Kapuas district. (2) A discussion focuses on decentralisation and forest management, analysing the financial situation of the district administration, the efforts of the district government to create district laws to regulate the forestry sector in the district, and the initial impacts of decentralisation on spatial planning and environmental management. (3) Analyses the situation of timber concessionaires in Gunung Mas just before the decentralisation laws took effect, focusing on the changing relationships among timber companies, the local administration and local communities. The case study examines the endemic conflicts occurring between local communities and logging concessionaires in the area. Finally, it draws some conclusions regarding the impact of decentralisation on forest management in the district.
