Small-scale fishers and their communities highly depend on secure access to fisheries resources and to the beaches that allow fishers to access the fishing grounds, to land their catches, and store and maintain their boats, gear and equipment. Landing sites are also often a place that women use for fish processing and marketing activities. These tenure rights for fishing grounds and landing sites are of crucial importance for the livelihoods of small-scale fishers and for food and nutrition security for fishing communities, and for the coastal population in most countries. Most of the landing sites for small-scale fisheries in Ghana are under increasing demand to use the beaches for other purposes, such as tourism, urban and commercial activities. Small-scale fishers also have major challenges pertaining to their exclusive use of the Inshore Exclusive Zone (IEZ), reserved for the small-scale fishing for small pelagic fish. In recent years there are major conflicts with industrial fleet that are trans-shipping (by)-catches of small pelagic fish to canoes at sea, which are subsequently landed unrecorded in Ghana. In addition, the industrial trawlers are regularly fishing illegally within the IEZ for small pelagic fish. Through the European Union Land Governance Programme support has been provided to develop the capacities of small-scale coastal fishing communities to secure their tenure rights, secure the fish landing and processing sites and reduce the incidence of illegal, unreported and unregulated (IUU) fishing. Capacities of clam fishery producers was also developed. The aim was to secure and sustain the livelihoods of the small-scale fishers.

The guidelines are the first comprehensive, global instrument on tenure and its administration to be prepared through intergovernmental negotiations.The guidelines set out principles and internationally accepted standards of responsible practices for the use and control of land, fisheries and forests. They provide guidance for improving the policy, legal and organizational frameworks that regulate tenure rights; for enhancing the transparency and administration of tenure systems; and for strengthening the capacities and operations of public bodies, private sector enterprises, civil society organizations and people concerned with tenure and its governance.The guidelines place the governance of tenure within the context of national food security, and are intended to contribute to the progressive realization of the right to adequate food, poverty eradication, environmental protection and sustainable social and economic development.

This book provides a transdisciplinary assessment of multiple countries’ legal and policy frameworks vis-à-vis the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication, adopted in 2014 by the Committee on Fisheries of the Food and Agriculture Organization of the United Nations. Based on an appraisal framework used to facilitate the unpacking of those frameworks, this book collects country experiences and regional perspectives on a range of cross-cutting issues underpinning the protection of the rights and the promotion of justice for small-scale fishers and their communities. This book aims to be the first collection to present a systematic and in-depth assessment of existing national legal and policy frameworks vis-à-vis the SSF Guidelines. This assessment is done through the transdisciplinary and collaborative work of researchers, governments, and civil society organizations for the analysis of the cross-thematic questions, which the contributors of this book aim to address. Firstly, what are the relevant laws and policies that matter for securing rights of small-scale fishers and their communities? How are small-scale fisheries defined by national laws and policies? How are small-scale fisheries treated (i.e., specifically or generally) in these instruments? Are there specific provisions and references to small-scale fisheries or any of its associated terminologies (e.g., artisanal, subsistence, traditional, indigenous)? Secondly, how the relevant instruments address the 8 small-scale fisheries key issues outlined in that rapid appraisal study? What are the strengths and gaps in these instruments? Do they address issues that are not covered by the SSF Guidelines? Do they contribute to clarifying other legal issues that are relevant for sustainable small-scale fisheries? Finally, since the book also aims to explore the accessibility of these legal and policy instruments for those to which they matter the most (the small-scale fishers), the following questions were also considered: What challenges do they face in knowing and understanding the relevant laws and policies in place? Which tools, measures and processes are available in the countries to ensure small-scale fishers can claim for their rights? To what extent judicial courts have recognized and/or granted rights to small-scale fishers? The Voluntary Guidelines for Securing Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) are the first international instrument dedicated entirely to the small-scale fisheries sector. While the implementation of the SSF Guidelines will require legal and regulatory adjustments beyond national fisheries legislation to ensure political and legislative coherence and fully reflect the breadth of their provisions, the fundamental function of fisheries law in a sustainable use, management, and the development of small-scale fisheries is indisputable. Appropriate fisheries legislation provides the strongest possible framework for inclusive, participatory fisheries governance and resource management by providing a coherent basis for implementing and enforcing the SSF Guidelines and other related international and regional agreements and commitments. In June 2014, FAO member-states endorsed the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries (SSF Guidelines).
