This book discusses all critical privacy and data protection aspects of biometric systems from a legal perspective. It contains a systematic and complete analysis of the many issues raised by these systems based on examples worldwide and provides several recommendations for a transnational regulatory framework. An appropriate legal framework is in most countries not yet in place. Biometric systems use facial images, fingerprints, iris and/or voice in an automated way to identify or to verify (identity) claims of persons. The treatise which has an interdisciplinary approach starts with explaining the functioning of biometric systems in general terms for non-specialists. It continues with a description of the legal nature of biometric data and makes a comparison with DNA and biological material and the regulation thereof. After describing the risks, the work further reviews the opinions of data protection authorities in relation to biometric systems and current and future (EU) law. A detailed legal comparative analysis is made of the situation in Belgium, France and the Netherlands. The author concludes with an evaluation of the proportionality principle and the application of data protection law to biometric data processing operations, mainly in the private sector. Pleading for more safeguards in legislation, the author makes several suggestions for a regulatory framework aiming at reducing the risks of biometric systems. They include limitations to the collection and storage of biometric data as well as technical measures, which could influence the proportionality of the processing. The text is supported by several figures and tables providing a summary of particular points of the discussion. The book also uses the 2012 biometric vocabulary adopted by ISO and contains an extensive bibliography and literature sources.

In 1967, Justice John Marshall Harlan introduced the litmus test of ‘a reasonable expectation of privacy’ in his concurring opinion in the US Supreme Court case of Katz v. United States. Privacy, regulations to protect privacy, and data protection have been legal and social issues in many Western countries for a number of decades. However, recent measures to combat terrorism, to fight crime, and to increase security, together with the growing social acceptance of privacy-invasive technologies can be considered a serious threat to the fundamental right to privacy. What is the purport of ‘reasonable expectations of privacy’? Reasonable expectations of privacy and the reality of data protection is the title of a research project being carried out by TILT, the Tilburg Institute for Law, Technology, and Society at Tilburg University, The Netherlands. The project is aimed at developing an international research network of privacy experts (professionals, academics, policymakers) and to carry out research on the practice, meaning, and legal performance of privacy and data protection in an international perspective. Part of the research project was to analyse the concept of privacy and the reality of data protection in case law, with video surveillance and workplace privacy as two focal points. The eleven country reports regarding case law on video surveillance and workplace privacy are the core of the present book. The conclusions drawn by the editors are intended to trigger and stimulate an international debate on the use and possible drawbacks of the ‘reasonable expectations of privacy’ concept. The editors are all affiliated to TILT – Tilburg Institute for Law, Technology, and Society, Tilburg University, The Netherlands. This dissertation delves into the reconstruction of past vegetation at the most detailed level. It is not the objective to focus solely on the developments in vegetation over time, but to create an image of the landscape that must have been visible to prehistoric people. Landscape and vegetation form a major starting point for the opportunities available in a certain area for a broad scale of human activities including grazing of livestock, cultivating crops and collecting wild plants. The majority of the analyses are based on seeds and fruits (botanical macroremains) from two Dutch prehistoric regions. These are the small river system in the present Flevopolder, home to settlements of the so-called Swifterbant Culture in the Neolithic period (4300 ‒ 4000 BC), and the Frisian-Groningen terp region in the period prior to the endikements (700 BC ‒ c. 1200 AD).

This book examines Nile water security through the morphology of the river: it uses the always changing form of the river as a theoretical and empirical device to map and understand how infrastructures and discourses dynamically interact with the Nile. By bringing a history of two centuries of dam development on the Nile in relation with the drainage of a hill slope in Ethiopia on the one hand and irrigation reform in Sudan on the other, the author shows how the scales, units and ‘populations’ figuring in projects to securitize the river emerge through the rearrangement of its water and sediments. The analysis of ‘Making water security’ is more than yet another story of how modern projects of water security have legitimized often violent dispossessions of Nile land and water. It shows how no water user is confined by the roles assigned by project engineers and planners. As ongoing modern ‘development’ of the river reduces the prospects for new large diversions of water, the targeted subjects of development and modernization make use of newly opened spaces to carve out their own projects. They creatively mobilize old irrigation and drainage infrastructures in ways that escape the universal logic of water security.

Technical artifacts are both plain physical objects and objects that have been purposefully made for a purpose; they have a physical structure and a technical function. As a result, they belong equally in a purely physical conceptualization of the world, in which human intentions and goals seem to have no place, and in an intentional conceptualization, which is used to describe and understand people and their mental lives. This book explores how this observation plays out in the contexts of artifact design and explanation of how artifacts fulfill their function. It addresses the following questions: How do designing engineers get from a functional description of desired behavior to the concrete object that is the result of a design process? What do explanations of how an artifact fulfills its function look like and do they differ from explanations of natural systems?
