Après avoir longtemps bénéficié d'une confiance absolue, le progrès des sciences et des techniques suscite aujourd'hui les plus vives interrogations. A l'origine de progrès technologiques sans précédent, l'amélioration des connaissances ne permet pas toujours d'en maitriser totalement les effets. Le risque technologique pose ainsi la question des relations entre la mise en oeuvre des pouvoirs technologiques et le savoir scientifique. Le renforcement du droit à la sécurité des personnes justifiait par conséquent une régulation juridique des technologies susceptibles d'y porter atteinte. Sollicité afin de tenter d'en résorber les risques, le droit a dû s'adapter à cette relativité des connaissances scientifiques. Consacré juridiquement par le principe de précaution, le concept d'incertitude rappelle la double fonction du droit de la responsabilité civile. Il permet d'abord de poursuivre l'évolution amorcée au XIXe siècle et de renforcer la créance d'indemnisation de la victime. L'incertitude scientifique n'est pas de nature à exonérer celui qui a mis en oeuvre la technologie puisqu'elle ne le prive pas de sa liberté d'agir. Il appartient par conséquent au producteur de répondre des dommages qui pourraient en résulter. L'incertitude scientifique révèle en outre la la possibilité de prendre la mesure des conséquences du pouvoir technologique développé. El e est elle-même la source d'une obligation qui exige une particulière vigilance dans l'amélioration de la connaissance du risque et de l'information. Celui qui crée le pouvoir technologique au mépris des incertitudes scientifiques doit désormais en répondre. Le principe de précaution lui impose d'adopter une véritable méthodologie du doute en univers incertain. Il doit non seulement tenter de réduire le décalage entre les pouvoirs technologiques qu'il libère et le savoir dont il dispose, mais en assumer les conséquences dommageables éventuelles. L'effectivité du droit de la responsabilité civile est en effet subordonnée à la mise en place de garanties collectives indispensables en présence d'atteintes à la sécurité des personnes ou de son environnement.

L'émergence du principe de précaution accompagne le progrès scientifique, et traduit la prise de conscience des limites du principe de prévention. Consacré dans le champ de la protection de l'environnement, ce principe a aussi vocation à s'appliquer dans le domaine de la santé publique. Si la doctrine juridique s'accorde pour considérer le principe de précaution comme un outil fondamental de prévention des " risques incertains ", une certaine confusion caractérise cependant la réflexion sur sa valeur juridique, sa signification et ses implications. À travers l'analyse de plusieurs dispositifs juridiques, relatifs à la gestion du risque alimentaire, du risque biotechnologique, du risque médicamenteux, du risque radiologique, et du risque chimique lié aux émissions polluantes des installations classées, cet ouvrage s'efforce de revisiter les instruments du droit de la prévention des risques technologiques sous l'angle nouveau de l'articulation entre seuil de connaissances et décision. Cette analyse permet de remettre en cause un certain nombre d'idées reçues, elle fait ainsi clairement apparaître que le principe de précaution était présent d'une manière substantielle dans le droit positif avant même sa consécration législative en 1995. Son intégration juridique n'entraîne pas, par conséquent, de phénomène de rupture par rapport au droit existant, ni sur le plan instrumental, ni sur le plan des objectifs poursuivis, puisque ce n'est pas la sécurité absolue (le " risque zéro ") mais la sécurité optimale qui est visée.

This book is the first major study of the making of transnational food safety law in China. Francis Snyder shows how the 2008 melamine infant formula crisis led to China’s first food safety law and new food safety standards, substantial reforms in government policy and closer relations with international organisations. He also identifies current and future challenges and makes recommendations for dealing with them. Chinese food safety law today is influenced strongly by cross-border factors. While transnational regimes help to shape domestic decisions, many institutions deeply embedded in Chinese society have played key roles in this transformation. Francis Snyder emphasises that, in finding its own path toward ensuring food safety, China can both learn from and teach other countries.
