In March 2013, Scottish First Minister Alex Salmond announced that the long-awaited referendum on Scottish independence would take place on 18 September 2014. More often than not, those in favour of an independent Scotland present their fight as a constitutional means to a socio-economic end. In the words of Alex Salmond himself: “Progress to independence. Not for its own sake, not ‘let’s be independent so we can hoist the Saltire’. Let’s be independent so we can better the lives of the Scottish people.” (quoted by Tom Peterkin, “Alex Salmond: ‘I’d be a labourer if it wasn’t for Mum’” – Scotland on Sunday, 16 January 2011) If, as suggested by the quote, breaking with the rest of the UK automatically means improved socio-economic performance, one consequently has to accept that there is only one constraint weighing Scotland down, and that it is the Union. However, is it all really that simple? Another commonly overlooked difficulty is that independence – that is to say, a Scottish state for a Scottish nation – inevitably goes hand in hand with a redefinition of national solidarity within a strictly Scottish context. This begs the question: how do Nationalists justify this redefinition when their country has been an integral part of a particularly fluid group of nations since the early 18th century? The last delicate issue raised by the Scottish referendum has to do with state building and the Nationalists’ heavy reliance on the promotion of civic nationalism despite the notion’s inherent limits.

As recently as the mid-2000s, Catalonia was described and analysed by scholars as exhibiting a non-secessionist nationalism and was seen within Europe and beyond as a role model for successful devolution which had much to teach other parts of the world. The Spanish state seemed to be on a journey towards an authentic federal order and was generally admired. However, the new century has been marked by an ever-growing independence movement, with 47.8 per cent of Catalonia voting in favour of independence in September 2015. Pro-independence mobilization has produced a rupture in political relations with the rest of Spain leading to a sovereignty struggle with Madrid. This book explores how an accumulation of long-, medium- and short-term factors have produced the current situation and why the Spanish territorial model has been unable or possibly, unwilling, to respond. The Catalan question is not purely a Spanish problem: it has direct implications for the traditional nation-state model, in Europe and beyond.

This volume purports to explore the legal and political issues triggered by the new wave of secessionism. More specifically, those issues concern the interplay between notions of democracy (and democratic ends and means) and law (and the rule of law and constitutionalism). The use of referendums around the world has grown remarkably in the past thirty years and, in particular, referendums are today deployed more than ever in the settlement of constitutional questions, even in countries with little or no tradition of direct democracy. This is the first book by a constitutional theorist to address the implications of this development for constitutional democracy in a globalizing age, when many of the older certainties surrounding sovereignty and constitutional authority are coming under scrutiny. The book identifies four substantive constitutional processes where the referendum is regularly used today: the founding of new states; the creation or amendment of constitutions; the establishment of complex new models of sub-state autonomy, particularly in multinational states; and the transfer of sovereign powers from European states to the European Union. The book, as a study in constitutional theory, addresses the challenges this phenomenon poses not only for particular constitutional orders, which are typically structured around a representative model of democracy, but for constitutional theory more broadly. The main theoretical focus of the book is the relationship between the referendum and democracy. It addresses the standard criticisms which the referendum is subjected to by democratic theorists and deploys both civic republican theory and the recent turn in deliberative democracy to ask whether by good process-design the constitutional referendum is capable of facilitating the engagement of citizens in deliberative acts of constitution-making. With the referendum firmly established as a fixture of contemporary constitutionalism, the book addresses the key question for constitutional theorists and practitioners of how might its operation be made more democratic in age of constitutional transformation.
