Es evidente que en la formación de la voluntad del testador manifestada en su testamento tienen un peso especial las circunstancias personales y familiarespor las que atraviesa en el momento de su otorgamiento. El testamento es, en este sentido, fruto de la realidad en la que se realiza. Sin embargo, el testador no puede prever ni tomar en consideración aquellas situaciones que todavía no se han producido o que ni siquiera era previsible que tuvieran lugar. Con este punto de partida, las dudas que surgen, y que en esta monografía se pretenden resolver, son variadas: ¿ese cambio de circunstancias podría entenderse que ha generado una alteración de la voluntad sucesoria?; ¿existe algún instrumento jurídico para que esa presumible mutación en los deseos sucesorios del testador pueda ser tenida en cuenta aun cuando no se haya canalizado con las solemnidades debidas? ¿Cabría considerar, en fin, la ineficacia de aquellas disposiciones que se realizaron en un contexto determinado pero que, posteriormente, se altera por completo?En esta tarea, es preciso detenerse primero en la revisión y concreción del régimen y extensión de la interpretación de los testamentos y, después, en el alcance y los requisitos de su posible revocación, ya que la amplitud, funciones y contenido que a ambas cuestiones se asignen determinará su idoneidad o no para servir de cauce para la adecuación del testamento a las nuevas situaciones vitales por las que discurra la existencia del testador. Por otro lado, se examina la utilidad del recurso al criterio de la causa falsa prevista en el art. 767.1 del Código Civil, al que recientes sentencias del Tribunal Supremo acuden para conseguir objetivos similares y que, a juicio del autor, presenta serias dudas. Asimismo, y de forma particular, se analiza la viabilidad de la denominada interpretación integradora del testamento como opción clara para poder concretar la voluntad del testador sobre los efectos que esos cambios sobrevenidos deberían provocar, en su caso, en su planificación sucesoria.
