Jusqu'à la loi du 13 mars 2000, l'écrit sur support papier dominait le processus probatoire. Le développement exponentiel des technologies nouvelles de l'information et des échanges numériques ont amené le législateur a œuvré dans le sens d'une adaptation du droit de la preuve aux technologies nouvelles de l'information. C'est dans ces conditions que la loi du 13 mars 2000 a consacré la fin du monopole du support papier dans la hiérarchie des preuves en reconnaissant à l'écrit et à la signature électronique une force probante équivalente. La loi du 21 juin 2004 pour la confiance dans l'économie numérique a renforcé cette consécration en admettant que lorsqu'un écrit est exigé pour la validité d'un acte juridique, celui-ci peut être établi et conservé sous forme électronique. Toutefois, cette reconnaissance juridique ne pouvait valablement intervenir sans que le législateur impose un certain nombre de garanties. La signature électronique en est devenue le gage.
