Today, transparency is a widely heralded value, and the U.S. Freedom of Information Act (FOIA) is often held up as one of the transparency movement’s canonical achievements. Yet while many view the law as a powerful tool for journalists, activists, and ordinary citizens to pursue the public good, FOIA is beset by massive backlogs, and corporations and the powerful have become adept at using it for their own interests. Close observers of laws like FOIA have begun to question whether these laws interfere with good governance, display a deleterious anti-public-sector bias, or are otherwise inadequate for the twenty-first century’s challenges. Troubling Transparency brings together leading scholars from different disciplines to analyze freedom of information policies in the United States and abroad—how they are working, how they are failing, and how they might be improved. Contributors investigate the creation of FOIA; its day-to-day uses and limitations for the news media and for corporate and citizen requesters; its impact on government agencies; its global influence; recent alternatives to the FOIA model raised by the emergence of “open data” and other approaches to transparency; and the theoretical underpinnings of FOIA and the right to know. This book analyzes the different ways in which forced migration comes together with organized violence in the Americas, focusing specifically on the migration corridor from Central America, through Mexico and on to the United States. No matter their starting point, most South and Central American migrants to the United States must eventually traverse Mexico, and often many other borders beforehand, to reach their destination. As border controls tighten, for many migrants turning back is not a possibility, or something they desire. And so, when faced with hardening policies, migrants are often forced into situations of increased violence and precarity, without a shift in their ultimate objective. This book analyzes the complex social situations of everyday violence, and increasingly aggressive border controls, which face migrants in Mexico, as well as their exposure to a different kind of violence during their migration trajectory through the criminal actors such as gangs, cartels, and corrupt law enforcements that seek to make a profit from them. The book takes a critical approach on migration policies and on the externalization of borders by analyzing their effects on the trajectories and experiences of migrants themselves. It shows that the more migrants’ opportunities and rights during transit are hindered, the more they are at risk of exposure to these actors. Foregrounding the voices of migrants, this book offers fresh insights into debates surrounding migration, politics, international relations, and anthropology in the Americas.

La tesis de la investigadora, defendida en 2017 en la Universidad de Deusto y dirigida por los profesores Felipe Gómez Isa y Carlos Martín Beristain, analiza el que califica de “conflicto olvidado” del Sahara Occidental desde la perspectiva de los derechos humanos abordando, en particular, el delito de desaparición forzada. Para ello, la autora, que formó parte del equipo de trabajo de la investigación que desembocó en “El Oasis de la Memoria”, analiza en detalle 95 casos de desaparición forzada, 86 de ellos recogidos en dicha publicación y los nueve restantes, en “Meheris: la esperanza posible”. La investigadora indica que es necesaria “una voluntad política real por transformar la realidad y romper con el pasado de violaciones de derechos humanos” y denuncia que “no se haya respetado el derecho de las víctimas a la verdad”. Los resultados del trabajo, según apunta López, se espera que sirvan para que las personas afectadas puedan defender sus derechos ante las instancias internacionales y la Audiencia Nacional española.

This book is grounded in an extended analogy between the 19th century story of the Underground Railroad in North America, transporting fugitive slaves to safety in the North, and the 21st century routes and trails of migrant passages to and within Europe. It begins as a kind of historical travelogue tracing the remnants of the 19th-century Underground Railroad in the US and Canada, including its legacies and unfulfilled heritage. It then shifts to the political present by ethnographically sketching a series of different border instances and situations, both external and within the EU space (Ventimiglia, Athens, Paris, Calais, Ceuta and Melilla, Patras, Pozzallo). Focusing on the violent harshening of local border regimes, this book nonetheless suggests a different picture, one conceived as the dynamic effect of both migrants autonomy and of the solidarity provided by local and international groups. Focusing on these specific and contested situations, it is possible to reverse the image of a main borderland into one of a space crisscrossed by many routes and passages. Reading those experiences through the historical lens of the US antebellum Underground Railroad, the book suggests the idea of an analogous "Underground Europe".

This book delves into the reasons behind and the consequences of the implementation gap regarding the right to prior consultation and the Free, Prior and Informed Consent (FPIC) of Indigenous Peoples in Latin America. In recent years, the economic and political projects of Latin American States have become increasingly dependent on the extractive industries. This has resulted in conflicts when governments and international firms have made considerable investments in those lands that have been traditionally inhabited and used by Indigenous Peoples, who seek to defend their rights against exploitative practices. After decades of intense mobilisation, important gains have been made at international level regarding the opportunity for Indigenous Peoples to have a say on these matters. Notwithstanding this, the right to prior consultation and the FPIC of Indigenous Peoples on the ground are far from being fully applied and guaranteed. And, even when prior consultation processes are carried out, the outcomes remain uncertain. This volume rigorously investigates the causes of this implementation gap and its consequences for the protection of Indigenous Peoples’ rights, lands, identities and ways of life in the Latin American region. This edited volume examines the extent to which the various authorities and actors currently performing border management and expulsion-related tasks are subject to accountability mechanisms capable of delivering effective remedies and justice for abuses suffered by migrants and asylum seekers. Member states of the European Union and State Parties to the Council of Europe are under the obligation to establish complaint mechanisms allowing immigrants and/or asylum seekers to seek effective remedies in cases where their rights are violated. This book sheds light on the complaint bodies and procedures existing and available in Austria, Greece, Hungary, Italy, Spain, Poland, and Romania.
