Studienarbeit aus dem Jahr 2007 im Fachbereich Pflegewissenschaft - Altenpflege, Altenhilfe, Note: 1,0, Universität Vechta; früher Hochschule Vechta, Veranstaltung: Sozialrecht, Sprache: Deutsch, Abstract: Mit dem Pflege-Qualitätssicherungsgesetz (PQsG) wurde zum 1.1.2002 das Qualitätssicherungskonzept nach dem SGB XI erheblich ausgeweitet. Bis zum 31.12.2001 stellte der § 80 SGB XI a. F. die zentrale Qualitätsnorm des Pflegeversicherungsgesetzes mit drei Instrumenten dar: Qualitätsvereinbarungen nach § 80 Abs. 1 SGB XI, Beteiligung an Qualitätssicherungsmaßnahmen nach § 80 Abs. 2 Satz 1 SGB XI, Prüfungen durch den MDK nach § 80 Abs. 2 Satz 2 SGB XI. Zwar bleibt auch nach dem 1.1.2002 der § 80 SGB XI eine zentrale Vorschrift zur Qualitätssicherung, jedoch wird dieser durch §§ 112 ff. SGB XI ergänzt und konkretisiert. Zudem gibt es im Qualitätssicherungskonzept fünf neue Instrumente: Einführung und Weiterentwicklung eines einrichtungsinternen Qualitätsmanagements nach Maßgabe der Qualitätsvereinbarung nach § 80 SGB XI (§ 72 Abs. 3 Nr. 3 SGB XI), Leistungs- und Qualitätsvereinbarung (LQV) nach § 80a SGB XI, Pflegeheimvergleich nach § 92a SGB XI, Leistungs- und Qualitätsnachweise (LQN) nach § 113 i. V. m. § 118 SGB XI, Sanktionen nach § 115 SGB XI.4 Mit der Einführung der LQV nach § 80a SGB XI verfolgt der Gesetzgeber das Ziel, die Verhandlungsqualität zwischen den Leistungserbringern und den Kostenträgern zu verbessern. Diese Zielsetzung war nach der amtlichen Begründung dringend gegeben, da ein Großteil der stationären Altenpflegeeinrichtungen schon vor Einführung der Pflegeversicherung existierten und aufgrund des Bestandschutzes in den Versorgungsverträgen nach § 72 SGB XI keine konkreten Leistungsinhalte festgelegt wurden. Somit fehlte eine Verbindung zwischen Versorgungsvertrag nach § 72 SGB XI und der Vergütungsvereinbarung nach § 85 SGB XI. Des weiteren sollte der Vorwurf „einer Vergütung nach Kassenlage“ entkräftet und eine leistungsgerechte Vergütung der Einrichtungen nach § 84 SGB XI gewährleistet werden. Darüber hinaus soll die zu erbringende Qualität der stationären Altenpflegeeinrichtungen für ihre Kunden transparenter und überprüfbar werden. Aus diesem Grund sollten die LQN nach § 113 i. V. m. § 118 SGB XI und ein Pflegeheimvergleich auf der Basis von abgeschlossenen LQVen und Vergütungsvereinbarungen nach § 92a SGB XI als ergänzende Instrumente der Qualitätssicherung eingeführt werden. Beide Instrumente hat der Gesetzgeber jedoch bis heute nicht umgesetzt, sodass in der Praxis von den Vertragspartnern eine Umsetzung der LQV oftmals als bürokratische Mehrbelastung ohne Effizienzsteigerung betrachtet wird.
