Dentro de esta gran obra de INSTITUCIONES DE DERECHO PRIVADO y, concretamente, dentro de su Tomo VI de Derecho Mercantil, no podía faltar un volumen dedicado especialmente a los contratos bancarios. Es innecesario destacar la importancia económica que tienen las entidades bancarias en la financiación y gestión de los fondos de familias, empresas y administraciones públicas, lo que siempre se plasma en contratos. La trascendencia jurídica de esta contratación es también es innegable, no solo por su importancia cuantitativa, sino también porque difícilmente en la vida de las personas y las empresas no se hace necesario en algún momento un contrato bancario. Entre estos destacan los de financiación en los que el notariado tiene una intervención más destacada. En efecto, sin perjuicio del principio de libertad de forma que rige tanto en el ámbito de la contratación civil como en la mercantil, la instrumentación de estos contratos en documentos públicos autorizados o intervenidos por Notario es no sólo frecuente sino, en muchos casos, necesaria, como ocurre con los contratos de crédito inmobiliario. Sin perjuicio del debido asesoramiento a la parte adherente con el que pretende equilibrar la asimetría de información en la que se encuentra el cliente frente a la entidad de crédito, está el control de legalidad que realiza el Notario, quedando asegurado así el cumplimiento de las normas tuitivas aplicables a los contratos bancarios y, muy especialmente, las referentes a su transparencia. Tampoco hay que olvidar la ventaja que obtiene la entidad de crédito de la intervención notarial habida cuenta que el documento público es también título ejecutivo por lo que dota a su crédito de una mayor eficacia jurídica a la hora de reclamar las cantidades impagadas.
