For most countries, economic development involves a process of 'catching up' with leading countries at the time. This is never achieved solely by physical assets and labour alone: also needed are the accumulation of technological capabilities, educational attainment, entrepreneurship, and the development of the necessary institutional infrastructure. One element of this infrastructure is the regime of intellectual property rights (IPR), particularly patents. Patents may promote innovation and catch up, and they may foster formal technology transfer. Yet they may also prove to be barriers for developing countries that intend to acquire technologies through imitation and reverse engineering. The current move to harmonize the IPR system internationally, such as the TRIPS agreement, may thus have unexpected consequences for developing countries. This book explores these issues through an in depth study of eleven countries ranging from early developers (the USA, Nordic Countries and Japan), and Post World War 2 countries (Korea, Taiwan, Israel) to more recent emerging economies (Argentina, Brazil, China, India and Thailand). With contributions from international experts on innovation systems, this book will be an invaluable resource for academics and policymakers in the fields of economic development, innovation studies and intellectual property laws.

In recent years, Intellectual Property Rights - both in the form of patents and copyrights - have expanded in their coverage, the breadth and depth of protection, and the tightness of their enforcement. Moreover, for the first time in history, the IPR regime has become increasingly uniform at international level by means of the TRIPS agreement, irrespectively of the degrees of development of the various countries. This volume, first, addresses from different angles the effects of IPR on the processes of innovation and innovation diffusion in general, and with respect to developing countries in particular. Contrary to a widespread view, there is very little evidence that the rates of innovation increase with the tightness of IPR even in developed countries. Conversely, in many circumstances, tight IPR represents an obstacle to imitation and innovation diffusion in developing countries. What can policies do then? This is the second major theme of the book which offers several detailed discussions of possible policy measures even within the current TRIPS regime - including the exploitation of the waivers to IPR enforcement that it contains, various forms of development of 'technological commons', and non-patent rewards to innovators, such as prizes. Some drawbacks of the regimes, however, are unavoidable: hence the advocacy in many contributions to the book of deep reforms of the system in both developed and developing countries, including the non-patentability of scientific discoveries, the reduction of the depth and breadth of IPR patents, and the variability of the degrees of IPR protection according to the levels of a country's development.

Technological capability deepens and diversifies industrial activity, which fundamentally enhances growth potential. Consequently, failure to build effective technological capability can lead to slow long-term economic growth. This book synthesizes and interprets existing knowledge on technology upgrading failures in order to better understand the challenges of technology upgrading in emerging economies. The objective is to bring together diverse evidence on three major dimensions of technology upgrading: paths of technology upgrading, structural changes in the nature of technology upgrading, and the issues of technology transfer and technology upgrading. Knowledge on these three dimensions is synthesized at the firm, sector, and macro levels across different countries and world macroregions. Compared to the challenges and uncertainties facing emerging economies, our understanding of technology upgrading is sparse, unsystematic, and scattered. The recent growth slowdown in many emerging economies, often known as the middle-income trap, has reinforced the importance of understanding the technology upgrading challenges they experience. While our understanding of these issues from the 1980s and 1990s is relatively more systematised, the more recent changes that took place during the globalization and proliferation of global value chains, and the effects of the 2008 financial crisis, have not been explored and compared synthetically. The current effects of COVID-19, geopolitical struggles, and the growing concern around environmental sustainability add significant complexity to an already problematic situation. The time is ripe to take stock of our existing knowledge on processes of technology upgrading in emerging economies and make further inroads in research on this crucial issue.
