English summary: The interaction between legal scholarship, legal practice and social theory forms a crucial question of interdisciplinary research. The necessity and the limitations of such an interaction were the central subject of the 'foundations of law' panel's proceedings during the 2013 Marburg Congress of the German Association of Comparative Law. To begin with, the practice in the large centers of the USA, Europe and Japan was subjected to a legal comparative examination.
