What legal avenues do states have to regulate cannabis cultivations and trade for recreational use? This question has generated heated discussions in various societies, in political and academic discourses. Several states are considering adjusting or have adjusted their legal and policy approaches towards a more lenient regulation of cannabis cultivation and trade for the recreational user market.Volume I addresses the legal question of to which extent domestic initiatives involving the regulation of cannabis cultivation for recreational use are compatible with the relevant UN narcotic drugs conventions and European Union law. To this end, the book provides a comprehensive and detailed analysis of the UN Single Convention on Narcotic Drugs (1961), as amended by the Protocol in 1972, and the UN Convention against Illicit Traffic in Narcotic Drugs (1988). The relevant European law is also considered, particularly the so-called Schengen acquis (1985 Agreement and 1990 Implementation Agreement), the Joint Action on illegal drug trafficking (1996) and the Framework Decision on Illegal Drug Trafficking (2004). This analysis forms the basis for an evaluative framework for various initiatives that have advanced the regulation of cannabis cultivation for reactional use in several states, such as the coffeeshop system in the Netherlands, the steps towards legalisation of cannabis in several states in the Americas and Canada and the phenomenon of Cannabis Social Clubs.Volume II takes an innovative approach to this issue and approaches the possibility for regulation of cannabis for recreational use from the perspective of positive human rights obligations. To what extend can regulation of cannabis for recreational use, for the sake of health, safety and crime control, be considered a positive human rights obligation resulting from the right to health, the right to life, the right to physical and psychological integrity and the right to privacy? From the subsequent conclusions, a second pertinent question arises: what hierarchical relationship, if any, exists between these positive human rights obligations and the obligations arising from the UN drugs conventions? Through an in-depth and systematic analysis of relevant international human rights law and public international law, this book presents the steps, assumptions and conditions that are relevant if a state were to decide, on the basis of the incumbent positive human rights obligations, to permit cannabis cultivation and trade for the recreational user market under regulation.

Regulating Cannabis written by Toby Seddon and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-09-03 with Social Science categories.

This book explores one of the most pressing public policy questions for the 2020s: how should we regulate cannabis? The global cannabis prohibition regime is fragmenting as more countries experiment with decriminalization and legalization, and this book aims to make sense of this rapidly changing world. The ‘cannabis challenge’ is complex. How do we balance creating a potentially lucrative legal cannabis industry with protecting public health? How do we hardwire social and racial justice into our reform initiatives? How do we build a cannabis trade that is environmentally sustainable? The book seeks to make sense of our present through a state-of-the-art global review of cannabis law reform initiatives – mapping what has been done, where, and with what impacts. It attempts to generate new ideas for the future of cannabis regulation by viewing it through the lens of business regulation and learning lessons from how other consumer products are regulated.

As the largely illicit cannabis market transitions to a legal, regulated industry, the "canna-curious" and experienced industry participants alike are experiencing the harsh truth: Making a fortune in the legal cannabis industry is a challenge made even more difficult by a complex patchwork of state and federal laws. The Cannabis Business clears the confusion around topics such as the distinction between hemp and cannabis and why it matters for consumers and regulators, why CBD isn’t completely legal in the U.S., why and how states differ in their licensing processes, and how deal structuring is impacted by state regulations. Written by attorneys from the nation’s leading cannabis law and policy firm, this comprehensive primer on all things cannabis law is a must-have for anyone seeking to understand the major practical legal issues facing the cannabis industry in the U.S.

Dual Markets written by Ernesto U. Savona and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-11-14 with Social Science categories.

This comprehensive volume analyzes dual markets for regulated substances and services, and aims to provide a framework for their effective regulation. A “dual market” refers to the existence of both a legal and an illegal market for a regulated product or service (for example, prescription drugs). These regulations exist in various countries for a mix of public health, historical, political and cultural reasons. Allowing the legal market to thrive, while trying to eliminate the illegal market, provides a unique challenge for governments and law enforcement. Broken down into nine main sections, the book studies comparative international policies for regulating these “dual markets” from a historical, legal, and cultural perspective. It includes an analysis of the markets for psychoactive substances that are illegal in most countries (such as marijuana, cocaine, opiods and amphetimines), psychoactive substances which are legal in most countries and where consumption is widespread (such as alcohol and tobacco), and services that are generally regulated or illegal (such as sports betting, the sex trade, and gambling). For each of these nine types of markets, contributions focus on the relationship between regulation, the emerging illegal market, and the resulting overall access to these services. This work aims to provide a comprehensive framework from a historical, cultural, and comparative international perspective. It will be of interest to researchers in criminology and criminal justice, particularly with an interest in organized crime, as well as related fields such as sociology, public policy, international relations, and public health.

Canada has become the first G7 country to legalize cannabis, and the world is watching. The primary concern facing the Liberal government as it seeks to fulfill its 2015 campaign promise to “legalize, regulate, and restrict access to marijuana” is whether it can be done without making the situation worse. As the Liberal platform pointed out, the current regime lets illegal cannabis fall into the hands of minors, pours large profits into organized crime, and traps many people in the criminal justice system for what is arguably a victimless crime. While the legalization of marijuana in Canada begins with a straightforward change of the criminal code, its ramifications go far beyond this. Legalization will have a serious impact on the country's international treaty commitments, interprovincial relations, taxation and regulatory regimes, and social and health policies. The essays in this book address these outcomes from three main perspectives: the decades-long political path to legalization; the assumptions that underwrite the new policy, in particular the desire to stamp out the black market; and how legalization in Canada looks in an international context. Bringing together analysis by policy makers and scholars, including the architect of marijuana legislation in Portugal – a trailblazing jurisdiction – High Time provides an urgent and necessary overview of Canada's Cannabis Act.

The business of cannabis is exploding as: adult recreational markets open in some of the world's largest economies in defiance of international treaties; and governments increasingly approve research to develop medicinal forms of the drug. Cannabis Law and Regulation is a comprehensive analysis of the changing cannabis laws of more than 50 of the largest and most significant global markets, with insight from legal experts, political and government figures and public health officials. The business of cannabis is exploding as adult recreational markets open in some of the world's largest economies in defiance of international treaties and governments increasingly approve research to develop medicinal forms of the drug. Individual legal, compliance and tax issues are covered, where relevant, as the book examines existing recreational and medicinal cannabis laws and regulations, and where and why they are changing. The shift from black market product to regulated entity has legal ramifications for several service industries, from financial services and insurance to farming, cultivation, marketing, IP, copyright and trademark law. Cannabis Law and Regulation covers the US, Canada, Uruguay and other emerging areas where recreational use has been legalised, and the rapidly transforming European, African and Asian landscapes where a rush to become the top global medicinal cannabis hub is taking place. Where recent court cases, rulings, directives, government initiatives, trials and, in some cases, total decriminalisation have created a patchwork of global markets for participants to navigate and serve, Cannabis Law and Regulation is an essential legal guide. At approximately 150 pages, criminal and medical law practitioners, consultants, professors, doctors, business executives and drug regulators will find this a crucial, but quick read. Bloomsbury Professional Insights provide guidance for legal and tax practitioners on developing, specialist areas or existing, complex areas where understanding is required after recent changes in legislation or court decisions.

"At a time of increased debate on the laws controlling the use of cannabis in the European Union, this report answers some of the questions most often asked about cannabis legislation. Using a question and answer format, basic definitions and the obligations of countries under international law are set out in a section on 'What is cannabis and what are countries' obligations to control it?' Two following sections examine the links and disparities between the content of the laws and their guidelines on the one hand and the actual implementation of the laws on the other. The final question and answer section considers whether changes in law have affected cannabis use and how much public support for legal change exists, as it looks at the future direction of cannabis legislation in Europe"--Provided by publisher.
