It is generally considered that the UN Security Council has been galvanised since the end of the Cold War. However, the existence and development of armed conflicts remain the reality in the international scene. Is the upsurge in instances of invoking Chapter VII of the UN Charter truly a sign of the invigoration of the Security Council’s authority or mere evidence of its failure to prevent the aggravation of armed conflicts? To what extent is the Security Council authorised to exercise the peacekeeping power in order to take a more flexible approach to conflict management from an earlier stage of conflict? This book explores the potential of the UN peacekeeping power, placing Article 40 of the UN Charter at the centre of the legal regime governing peacekeeping measures. It traces the origins of peacekeeping measures primarily in the experience of the League of Nations and identifies Article 40 of the Charter as the primary legal basis for, and the legal restraints upon, the exercise of the peacekeeping power. It examines the regulatory framework within which the United Nations, particularly the Security Council, is authorised and may even be required to direct peacekeeping measures to prevent the aggravation of armed conflicts. It suggests that the legal accountability of the Security Council in directing peacekeeping measures will be enhanced by utilising procedural mechanisms for self-regulation

This book traces the process by which national elections became international events or, more precisely, what the effects of this process are on state sovereignty. Contrary to the conventional wisdom in International Relations - to judge by the neglect of this phenomenon in the literature - this book argues that the study of IEM does not belong only in the field of comparative politics. As a system-wide phenomenon, IEM should not be restricted to the study of purely domestic politics or of foreign policy. This book contends that sovereignty has been partially transformed by the recent emergence of IEM. Furthermore, the author locates the origins of this change in the Americas, claiming that the western hemisphere's normative structure - what Santa-Cruz calls the Western Hemisphere Idea (WHI) - was particularly conducive to this new understanding of state sovereignty. Monitoring Democracy argues that the practice of international election monitoring is broken, but still worth fixing. By analyzing the evolving interaction between domestic and international politics, Judith Kelley refutes prevailing arguments that international efforts cannot curb government behavior and that democratization is entirely a domestic process. Yet, she also shows that democracy promotion efforts are deficient and that outside actors often have no power and sometimes even do harm. This book analyzes a new phenomenon in international law: international organizations assuming the powers of a national government in order to reform political institutions. After reviewing the history of internationalized territories, this book asks two questions about these 'humanitarian occupations'. First, why did they occur? The book argues that the missions were part of a larger trend in international law to maintain existing states and their populations. The only way this could occur in these territories, which had all seen violent internal conflict, was for international administrators to take charge. Second, what is the legal justification for the missions? The book examines each of the existing justifications and finds them wanting. A new foundation is needed, one that takes account of the missions' authorisation by the UN Security Council and their pursuit of goals widely supported in the international community.
