This book seeks to understand the obligation of the international community to implement the principles of the Responsibility to Protect (R2P). With a focus on the humanitarian crisis in Syria, the volume examines what formal responsibility and actual capability international institutions have to protect and prevent civilians from systematic mass atrocities and presents an analysis of several prominent international organizations (IOs). Each chapter focuses on a specific organization and explores their formal responsibilities and how these pertain to the obligations of the R2P. Existing capabilities and actual abilities to address the challenges of R2P are analysed by looking at these issues before, during, and after the occurrence of the humanitarian crisis in Syria. With the UN not fully engaged in the Syrian conflict, the systematic human rights abuses have engendered greater attention on other organizations. This volume argues that if the UN Security Council’s inactions result in an abdication of responsibilities under the UN Charter, there should not only be a discussion of how the UN must alter its approach, but also an examination of whether there are alternative R2P paths for other MNOs to take in the name of international peace and human security. Ten new essays critique the practice armed humanitarian intervention, and the 'Responsibility to Protect' doctrine that advocates its use under certain circumstances. This edited volume critically examines the Responsibility to Protect (R2P) as a guiding norm in international politics. After NATO’s intervention in Libya, against the backdrop of civil wars in Syria and Yemen, and because of the cynical support for R2P by states such as Saudi Arabia, this norm is the subject of heavy criticism. It seems that the R2P is just political rhetoric, an instrument exploited by the powerful states. Hence, the R2P is being challenged. At the same time, however, institutional settings, normative discourses and contestation practices are making it more robust. New understandings of responsibility and the politics of protection are creating new normative spaces, patterns of legitimacy, and norm entrepreneurs, thereby reinforcing the R2P. This book’s goals are to discuss the R2P’s roots, institutional framework, and evolution; to reveal its shortcomings and pitfalls; and to explore how it is exploited by certain states. Further, it elaborates on the R2P’s strength as a norm. Accordingly, the contributions presented here discuss various ways in which the R2P is being challenged or confirmed, or both at once. As the authors demonstrate, these developments concern not only diplomatic communication and political practices within international institutions, but also to normative discourses. Furthermore, the book includes chapters that reevaluate the R2P from a normative standpoint, e.g. by proposing cosmopolitan standards as a guide for states’ external behavior. Situations of serious or massive violations of human rights are no longer purely of domestic concern, and sovereignty can no longer be an absolute shield for repressive governments in such circumstances. Based on this realization, the international community has recognized a responsibility to protect individuals in states where their governments are unable or unwilling to provide protection against the most serious violations. However, so far, only one intergovernmental organization, the African Union (AU), has explicitly made the right to intervene in a Member State part of its foundational text in Article 4(h) of its Constitutive Act. Although there have been cases of Article 4(h)-type interventions in Africa, the AU Assembly has not yet invoked Article 4(h) explicitly. This book brings together experts in the field to explore the potential application of Article 4(h), and the complexities that may explain its non-invocation so far. Although Article 4(h) is noble in purpose, its implementation faces several legal and policy challenges given that the use of force penetrates the principles of state sovereignty and non-intervention – the very cornerstones upon which the AU is founded. This book considers these issues, as well as the need to reconcile Article 4(h), in so far as it allows the AU to exercise military intervention to protect populations at risk of mass atrocities, with the provisions of the Charter of the United Nations.
