At the beginning of the nineties, there was an expectation within the human rights community that the next decade would be a period of consolidation for the international human rights regime. This did not happen. In fact, the human rights regime underwent dramatic changes in response to new circumstances. We have tried to highlight both the achievements and the challenges ahead in this Manual, the result of a joint project under the auspices of HumanitarianNet, a Thematic Network on Humanitarian Development Studies leaded by the University of Deusto (Bilbao, the Basque Country, Spain), and the European Inter-University Centre for Human Rights and Democratisation (EIUC, Venice, Italy).

On the occasion of the 20th anniversary of the World Conference of Human Rights in 1993 and the adoption of the Vienna Declaration and Program of Action (VDPA), an international high-level conference took place in Vienna in June 2013. The conference gathered some 200 experts from all parts of the world, who, on the one hand, reaffirmed the key achievements of the VDPA, such as the universality and indivisibility, as well as the legitimacy of the international protection of human rights; on the other hand, the experts addressed, on the basis of these accomplishments, current and future challenges to the international human rights system. In three working groups, as well as in various high-level public panels, discussions focused on the following thematic areas: strengthening the rule of law, realizing the human rights of women universally, and the preparation of a human rights-based approach for the post-2015 development agenda. The conference resulted in action-oriented recommendations to States and other actors, which were presented to the UN Human Rights Council, as well as the General Assembly, in Autumn 2013. This book offers insights from the conference. [Subject: International Law, Human Rights Law]

Ever since its creation, the United Nations has sought to protect as well as to promote human rights. Those who campaigned for decades for the establishment of the post of High Commissioner for Human Rights did so in the hope that the High Commissioner would spearhead the efforts of the United Nations and the international community to protect those at risk or whose rights are being violated. How has the High Commissioner contributed to international protection since the establishment of the office in 1993? This book, the first-ever written on the office since its establishment, presents the protection role of the High Commissioner. It argues that limited protection functions are carried out by the Security Council, the Secretary-General, the Commission on Human Rights and its special procedures, and the High Commissioner. However, international protection is still in its infancy and much more remains to be done to bring about a protection system that effectively anticipates and prevents gross violations, contributes to mitigation and cure, and facilitates remedies and compensation. This is a valuable pioneering work in the area of the international protection of human rights.

Throughout the first decades of its existence, many held the view that the UN Security Council would in some senses automatically encourage the protection of human rights by maintaining international peace. However since the end of the Cold War there have been growing concerns that the Council is a force with the potential to do harm to the cause of human rights, even to the extent of violating the rights of individuals. The chapters of this volume take a closer look at these two sides of the Security Council's involvement in human rights; both its efforts to promote and enforce human rights, and its actions that, with the intention of maintaining and restoring international peace, also have the potential to jeopardize human rights. This book represents a collection of individual views and appraisals of how the Council has dealt with human rights issues in the post-Cold War period, particularly in the cases of the economic sanctions imposed on Iraq and the targeted sanctions directed against the Taliban and supporters of the Al Qaida network. Written by experts in the field of international law, they are both positive and negative, critical and analytical. Together they offer a selection of different perspectives and evaluate the contribution of the Security Council to the promotion of human rights, highlighting possible avenue for improvement.

This book critically appraises the European Convention on Human Rights as it faces some daunting challenges. It argues that the Convention's core functions have subtly changed, particularly since the ending of the Cold War, and that these are now to articulate an 'abstract constitutional model' for the entire continent, and to promote convergence in the operation of public institutions at every level of governance. The implications - from national compliance, to European international relations, including the adjudication of disputes by the European Court of Human Rights - are fully explored. As the first book-length socio-legal examination of the Convention's principal achievements and failures, this study not only blends legal and social science scholarship around the theme of constitutionalization, but also offers a coherent set of policy proposals which both address the current case-management crisis and suggest ways forward neglected by recent reforms.

At the same time, scientific and technological developments are posing new challenges for human rights. This book identifies new dimensions in the international protection of human rights and makes the case for a new human rights diplomacy focusing on enlarging the area of common ground among governments and enhancing national human rights protection systems.
