The book provides an introduction to shipping in all its aspects. It is a valuable source of information for students of traditional maritime law as well as for those who seek to understand maritime and shipping services on a global scale. The text includes information and analytical content on national and international practices in shipping, including the age-old dichotomy between freedom in international shipping and the persistent demands of states to control specific maritime areas, as well as the tension between, on the one hand, the desire on the part of sovereign states to regulate and protect their shipping interests and, on the other, the abiding concern and unquestioned right of the international community to regulate the global shipping industry effectively, in order to ensure maritime safety, protection of the environment and fair competition.

This book assesses the extent to which two specialized UN agencies – the International Maritime Organization (IMO) in London and the International Civil Aviation Organization (ICAO) in Montreal – have been able to regulate environmental pollution in the global commons. Since the Kyoto Protocol and its tasking of these two public International Organizations (IOs) in 1997 to regulate greenhouse gas emissions from the fast-growing international shipping and aviation sectors, they have struggled with the assignment even as the external pressure has mounted for them to act. David Deese examines why these two UN agencies have largely failed to execute their critical missions to date and explores the most promising emerging and feasible routes to control and reduce these emissions by other means. Drawing on a range of sources including interviews with key actors in the IMO and ICAO, as well as from industry and national governments, Deese looks at the multifaceted politics that drive these IOs and considers how this has delayed and frustrated the execution of their assigned climate mitigation missions. He also explains how the limitations of the IMO and ICAO are likely to be found to a degree in other UN specialized agencies and examines how lessons learned here will be helpful in understanding the operations of other IOs. The book will be of great interest to students and scholars of global governance and IOs, transport, and environment and climate change. It will also be a useful resource for industry and non-profit experts and public officials working in shipping and aviation regulation.

“Marine transport, and the law and policy within which it operates, must be seen as very similar to other international undertakings operating on a transnational scale.” These concluding words in Edgar Gold’s Maritime Transport (Lexington, 1981) aptly capture the past, present and future of the regulation of international shipping. The Regulation of International Shipping: International and Comparative Perspectives in Honor of Edgar Gold pays tribute to a mariner, legal practitioner and university teacher with a unique understanding of shipping and maritime trade. With diverse disciplinary backgrounds and perspectives, the distinguished contributors to this tribute examine the public law and policy framework for international navigation, the complex relationship between shipping and the marine environment, the imperative of better protection of seafarers, and ultimately, responsible ocean use. This book includes biographical and bibliographic notes on Edgar Gold.

This book compiles seven essays concerning changes to merchant shipping over the hundred and fifty years between 1850 and 2000, and spanning a range of countries, with particular focus on Norway, Greece, Japan, and England. The essays are linked by the theme of change: from traditional to modern shipping; in fluctuating cargo demands; from sail to steam; wood to iron; in improvements in communication technologies; in political natures and affiliations; in seafaring skillsets; in the advent of containerisation and advent of globalisation. The overall aim is to construct a solid international context for the merchant shipping industry in the nineteenth and twentieth centuries - primarily to aid a major Norwegian deep-sea merchant marine project. The book contains an introduction that sets out these aims, and seven essays by maritime historians which form part of the international contextual whole, though all can be approached individually.
