Inhaltsangabe:Zusammenfassung: Die Magisterarbeit „Internet und Jugendschutz“ wurde im November 2001 am Institut für Kommunikationswissenschaft (LMU München) eingereicht und stellt eine umfassende, vielseitige und einen Überblick verschaffende Abhandlung zum Thema „Internet und Jugendschutz“ dar. Auch wenn Publikationen zum Thema „Internet“ aufgrund der hohen Dynamik und ständigen Veränderungen des Mediums Internet relativ schnell an Aktualität verlieren, kann diese Magisterarbeit als gründliche, aufwendig recherchierte Informationssammlung und -auswertung zum Thema gesehen werden. Sie stellt den über Jahrzehnte gehandhabten Jugendmedienschutz den Anforderungen des neuen Mediums gegenüber, zeigt Problemzonen auf, nennt Bemühungen von Seiten des Staates und privater Organisationen, wie auch technische, rechtliche und medienpädagogische Lösungsansätze. Unter dem Hintergrund der ständig ansteigenden Zahl von Internetnutzern (insb. Kinder und Jugendliche) zeigt sich, daß sich gerade im Hinblick auf den Jugendschutz das Internet von den traditionellen Medien wesentlich unterscheidet und der Jugendschutz dadurch mit neuen Rahmenbedingungen konfrontiert wird. Es stellt sich die allgemeine Frage, wie sich das Internet und die Anliegen des Jugendschutzes vereinbaren lassen. Einerseits sollen Kinder möglichst früh den Umgang mit dem neuen Medium erlernen, andererseits melden sich neben Befürwortern auch vermehrt kritische Stimmen zu Wort. Die potentielle Gefährdung von Jugendlichen und Kindern spielt hierbei eine zentrale Rolle. Nicht zuletzt durch die öffentliche Debatte und unzählige Meldungen in den letzten Jahren über pornographische oder rechtsextremistische Inhalte im Internet ist bekannt, daß im Internet nicht nur seriöse Angebote abrufbar sind. Die Leitfrage der Magisterarbeit lautet: Inwiefern müssen die Ansätze des Jugendschutzes in bezug auf das Internet überdacht werden? Als Annäherung an eine Beantwortung werden für den ersten großen Themenkomplex („Jugendmedienschutz vor der Kommerzialisierung des Internet“) folgende Untersuchungsfragen gestellt: Wozu bedarf es des Schutzes Jugendlicher und Kinder vor bestimmten Medieninhalten? Welche Medieninhalte gelten als jugendgefährdend bzw. strafbar? Welche Maßnahmen bestehen zur Wahrung des Jugendmedienschutzes? Der Autor befasst sich mit der hochaktuellen Thematik des Jugendschutzes im Internet. Die technischen Möglichkeiten dieses Mediums fordern den Staat heraus. Der Verfasser stellt die Rahmenbedingungen für eine effiziente Regulierung des Internet auf diesem Feld dar und zeigt neue Lösungsansätze auf. Zunächst werden Berührungspunkte der Kinder und Jugendlichen mit dem Internet und die daraus resultierenden Gefahren für deren Persönlichkeitsentwicklung beleuchtet. Um rechtliche Steuerungsstrategien entwickeln zu können, stellt Tim Faber Funktionsweise und Akteure des Internet im Überblick dar. Die staatsorganisatorischen und grundrechtlichen Möglichkeiten und Grenzen für eine staatliche Steuerung werden - von der Kompetenzproblematik bis zur Schutzpflicht - eingehend untersucht. Dabei stellt der Verfasser dem klassischen imperativen Jugendmedienschutz die neuen Gestaltungsmöglichkeiten der gesteuerten Selbstregulierung zur Seite. Der Jugendmedienschutz-Staatsvertrag und das Jugendschutzgesetz sind eingearbeitet und gewürdigt. Zur Effektivierung des Jugendschutzes bietet der Verfasser vielfältige Vorschläge, die sich auf das Konzept der gesteuerten Selbstregulierung stützen wie z. B. ein marktbestimmtes Ratingsystem mit staatlicher Koordinierungsstelle. Schließlich wird der Vorschlag eines bundeseinheitlichen Jugendmedienschutzes präsentiert.

Various national and international legal instruments punish hate speech. However, the specific nature of the Internet calls for the adoption of new strategies to combat hate speech promoting racism and violence, which is widely and swiftly disseminated on the web. As the Internet ignores territories and has no boundaries, states cannot control it effectively by unilateral national regulation; what is needed is increased international co-operation. Efforts to harmonise national legislation - including the Additional Protocol to the Council of Europe Convention on Cybercrime - have come up against a series of difficulties. One of these is the fact that there is no universally accepted definition of the illegal nature of racist speech, which can be protected by the right to freedom of expression. This book describes the situation in 10 Council of Europe member and observer, states and discusses the problems faced and solutions introduced by these countries, as well as by European and international organisations and civil society.

In religious education, digitization and mediatization processes result in the transformation of conventional media formats. This leads to the development of new media formats, which in turn necessitates a redefinition of the relationship between religious education and the media. Keeping this in mind, this volume first examines the importance of media for specific theological disciplines, and then discusses current media-pedagogical and media-didactic approaches. Later in the book, the authors develop didactic perspectives on various methods; these include internet-based archive work and the use of digital teaching materials. They also deal with current questions regarding religious education, such as inclusion and cyber bullying, etc. Finally, they identify some of the main didactic challenges for religious instruction in a mediatized world. This volume is a plea for a wider understanding of education, and is based in part on a German-Swedish teaching and research cooperation. Following this example, it focuses on a future-oriented networking of plural forms of education. The information society is a key issue in everyday life and a phenomenon enc- passing social, cultural, economic, and legal facettes. Currently, an information society’s legal framework is gradually crystallizing under the newly introduced term of “Internet governance”. During the last few years, intensive discussions about the contents of Internet governance have addressed manifold aspects of a possible regulatory regime. In light of the general comprehension that an international treaty structure is mi- ing and that self-regulation as a normative model does not sufce in all respects, new architectural and constitutional theories have been developed; furthermore, the international body of the Internet Governance Forum (IGF) came to life. N- withstanding the available literature on IGF, however, a thorough and systematic study sheding light on the main topics of Internet governance (such as legitimacy, transparency, accountability, and participation) and on the key regulatory issues (for example critical Internet resources, access, protection of civil liberties/- man rights, realization of security, safety and privacy standards, as well as the overcoming of the digital divide) from a legal perspective is not yet at hand. Inhaltsangabe:Einleitung: Die rasche technische Entwicklung des Mediums Internet stellt Gesetzgeber, Rechtsprechung und vollziehende Gewalt vor immer neue Herausforderungen. Der Gesetzgeber reagierte auf die zunehmende Gewaltbereitschaft bei Jugendlichen infolge des gesteigerten Konsums der Neuen Medien zum 1.4.2003 mit verschärften gesetzlichen Vorgaben in Form eines Jugendschutzgesetzes und des Jugendmediendienste-Staatsvertrages. Inhalt dieser Diplomarbeit war primär die Frage, inwieweit der von staatlicher Seite angestrebte effektive Jugendschutz im Internet einerseits und die verfassungsrechtlich garantierte Meinungsäußerungsfreiheit andererseits gewährleistet werden können. Darüber hinaus wird in dieser Arbeit geklärt, inwieweit anhand der bestehenden gesetzlichen Regelungen eine umfassende Kontrolle des Mediums Internet möglich ist und ob diese im Rahmen der Grundlagen eines demokratischen Verfassungsstaats vollständig in der Hand staatlicher Organe liegen sollte. Über eine Bewertung der bestehenden gesetzlichen Grundlagen hinaus, wird die Aufgabe des Staates, die Möglichkeiten präventiver wie repressiver Kontrolle von Internetinhalten und die notwendigen Grenzen staatlicher Kontrolle aufgezeigt. Den Abschluss bildet die Einbeziehung des internationalen Wirkungsbereiches des Internets.
