"En este libro se abordan algunos tópicos esenciales de la interpretación jurídica en general y de la interpretación constitucional en particular, desde el plano de la filosofía jurídica. El principal punto de partida de la temática es la indeterminación de las disposiciones normativas, lo cual conlleva al problema de la interpretación jurídica (tensión entre razón y voluntad en el plano interpretativo) que encuentra un soporte en una concepción del Derecho. Esta tensión cobra mayor fuerza cuando el objeto de la interpretación es la disposición constitucional que en la actualidad es precisamente la fuente del Derecho más importante, pero, sobre todo, porque la concepción del Derecho está detrás de una concepción de la Constitución y de la interpretación de la Constitución. Es necesario señalar que en el contenido del libro no sólo se advierte un tratamiento conceptual y lógico de las principales instituciones de la interpretación jurídica en general y de la interpretación constitucional en particular, sino también, se deja entrever a lo largo de los capítulos del texto, la defensa de una posición y la crítica hacia otras posturas".

La nueva teoría del constitucionalismo contemporáneo se manifestó, principalmente, en el proceso de constitucionalización del derecho, el cual implica que la Constitución impregna con sus valores y contenidos todos los ámbitos del derecho y de la vida social. Aquello, desde luego, supone un importante cambio en la comprensión del objeto y la interpretación del derecho, así como también en la relación entre este y la moral. Lo expuesto ha producido un verdadero cambio en los conceptos de Constitución, constitucionalismo e interpretación constitucional, lo cual, a su vez, ha redimensionado y potenciado la labor de jueces y juezas constitucionales. No obstante, ello no les otorga un poder sin control a estos juzgadores: su accionar tiene límites, como los que el autor nos explica en esta obra.
