This edited volume offers a comparative and interdisciplinary analysis of interrogation and questioning in war and conflict in the twentieth century. Despite the current public interest and its military importance, interrogation and questioning in conflict is still a largely under-researched theme. This volume’s methodological thrust is to select historical case studies ranging in time from the Great War to the conflicts in former Yugoslavia, and including the Second World War, decolonization, the Cold War, the ‘Troubles’ in Northern Ireland and international justice cases in The Hague, each of which raises interdisciplinary issues about the role of interrogation. These case-studies were selected because they resurface previously unexplored sources on the topic, or revisit known cases which allow us to analyse the role of interrogation and questioning in intelligence, security and military operations. Written by a group of experts from a range of disciplines including history, intelligence, psychology, law and human rights, Interrogation in War and Conflict provides a study of the main turning points in interrogation and questioning in twentieth-century conflicts, over a wide geographical area. The collection also looks at issues such as the extent of the use of harsh techniques, the value of interrogation to military intelligence, security and international justice, the development of interrogation as a separate profession in intelligence, as well as the relationship between interrogation and questioning and wider society. Traditional histories of the Korean War have long focused on violations of the thirty-eighth parallel, the line drawn by American and Soviet officials in 1945 dividing the Korean peninsula. But The interrogation rooms of the Korean War presents an entirely new narrative, shifting the perspective from the boundaries of the battlefield to inside the interrogation room. Upending conventional notions of what we think of as geographies of military conflict, Monica Kim demonstrates how the Korean War evolved from a fight over territory to one over human interiority and the individual human subject, forging the template for the U.S. wars of intervention that would predominate during the latter half of the twentieth century and beyond. Kim looks at how, during the armistice negotiations, the United States and their allies proposed a new kind of interrogation room: one in which POWs could exercise their "free will" and choose which country they would go to after the ceasefire. The global controversy that erupted exposed how interrogation rooms had become a flashpoint for the struggles between the ambitions of empire and the demands for decolonization, as the aim of interrogation was to produce subjects who attested to a nation's right to govern. With a renewed emphasis on national and homeland security, the United States is once again seeking to balance the needs of the state with both the rights of its citizens as well as those of other nations. This book represents an interdisciplinary approach to the legal dilemmas borne out by the war on terror-against the specific background of Afghanistan, Iraq, and this new kind of conflict. It is a strong contribution to a broader debate visible since 9/11, which will remain in the public eye for the foreseeable future. It addresses the overlap between religion, ethics, armed conflict, and law, within the context of the current conflict. While many issues in areas such as intelligence, reconciliation of civil liberties, dealing with terrorist threats, and the permissible bounds of interrogation, treatment of prisoners and laws governing armed conflict have long standing precedents under domestic and international law, this war has challenged even long standing legal interpretations. The contributors to this volume explore those precedents and contemporary challenges to them. Now that traditional wars between nation states are no longer the rule, the terrorist threat has gained credence (popularly, terrorism and its claimed breeding ground in failed states), linked in practice to issues of intervention on the territory of states harboring such groups. In military circles the idea of armed struggle between modern military forces and what were formerly called guerillas has now largely been replaced by asymmetric warfare and the concept of intelligence and preventive action interchangeably within U.S. borders and overseas. Opposing views contemplate that different-and presumably lower-legal standards may apply in internal armed conflicts. Such legal issues are visible under current circumstances of asymmetric warfare in conjunction with questions about prisoner status and detentions, including the permissible bounds of interrogation versus torture following the Abu Ghraib prison scandal in Iraq but also the treatment at the Guantanamo Bay facility of alleged Al Q'aeda captives from Afghanistan. All of the contributors in this book explore the changing circumstances against which these contentious new legal issues now unfold. The experts strike no consensus. Indeed, one of the work's many strengths can be attributed to the fact that the many facets of the ongoing debate are represented herein.

This essay consequently analyses one of the most controversial and insidious repercussions of the ‘War on Terror’: the U.S.’s use of torture on terrorist suspects. Ultimately, this paper argues that torture as a counter-terrorism tactic was an ill-conceived act of desperation that violated human rights, damaged the U.S. government’s integrity and potentially increased terrorism. For this reason, the U.S.’s choice of torture is argued to be the basest of its mistakes in its War on Terror. Thus, this discussion focuses on the emergence of Enhanced Interrogation Techniques, cases of torture at Guantanamo Bay, the indefensibility of torture and the irreconcilable consequences of state sponsored torture. To substantiate its main arguments, this analysis draws on the International Committee of the Red Cross Report On The Treatment Of Fourteen High Value Detainees In CIA Custody and reports from the Select Senate Committee on Intelligence.

"In September 2004, the Intelligence Science Board, an advisory board appointed by the Director of National Intelligence, initiated the Study on Educing Information (EI). This study is an ongoing effort to review what is known scientifically about interrogation and other forms of human intelligence collection and to chart a path to the future. As part of our efforts, we have worked closely with faculty and students of the National Defense Intelligence College. The NDIC Press published "Educing Information: Interrogation: Science and Art, Foundations for the Future," a book based on Phase I of the Study on EI. Three students, Special Agent James Stone, U.S. Air Force; Special Agent David Shoemaker, U.S. Air Force; and Major Nicholas Dotti, U.S. Army, completed master's thesis studies during Academic Year 2006-07 on topics related to interrogation. Special Agent Stone researched U.S. efforts during World War II to develop language and interrogation capacities to deal with our Japanese enemy. He found that military leaders, often working with civilian counterparts, created and implemented successful strategies, building on cultural and linguistic skills that substantially aided the war effort for the U.S. and its Allies. Special Agent Shoemaker studied the experiences of three successful interrogators during the Vietnam War. Like Stone, Shoemaker highlights the importance of a deep understanding of the language, psychology, and culture of adversaries and potential allies in other countries. Major Dotti examined recent policy and practice with regard to tactical and field interrogations, especially with regard to the efforts of Special Forces soldiers in Iraq. He concludes that the "letter" of current doctrine contradicts its "intent."
