Norms and Illegality: Intimate Ethnographies and Politics explores liminal and illegal practices in relation to political control and cultural normativity. The contributors draw on years of ethnographic experiences in Greece, Guatemala, Hong Kong, Italy, Madagascar, Mali, Philippines, and Thailand to study the contradictions of what is legal and illegal. They explore the production of illegal subjects by the state, the creation of illegal and normative values by liminal and illegal actors, and the mutual entanglements of legal and illegal in the public domains of markets and trade networks. This volume shows that criminalization policies are not necessarily oriented toward erasing crime. Instead, the contributors maintain that opaque spaces ensure the efficacy of control and outwardly conform to the rhetoric and ethics of global neoliberalism. Within these contexts, the contributors shed light on moral economies and frames of value entailed in systems of representation that have been set up by individuals who are deemed illegal, liminal, or deviant in their confrontations with the state. In her research with transnational Mexicans, Deborah A. Boehm has often asked individuals: if there were no barriers to your movement between Mexico and the United States, where would you choose to live? Almost always, they desire the freedom to come and go. Yet the barriers preventing such movement are many. Because of the United States' rigid immigration policies, Mexican immigrants often find themselves living long distances from family members and unable to easily cross the U.S.-Mexico border. Transnational Mexicans experience what Boehm calls intimate migrations, flows that both shape and are structured by gendered and familial actions and interactions, but are always defined by the presence of the U.S. state. Intimate Migrations is based on over a decade of ethnographic research, focusing on Mexican immigrants with ties to a small, rural community in the Mexican state of San Luis Potosi and several states in the U.S. West.By showing how intimate relations direct migration, and by looking at kin and gender relationships through the lens of illegality, Boehm sheds new light on the study of gender and kinship, as well as understandings of the state and transnational migration.

The Illegal City explores the relationship between space, law and gendered subjectivity through a close look at an 'illegal' squatter settlement in Delhi. Since 2000, a series of judicial rulings in India have criminalised squatters as 'illegal' citizens, 'encroachers' and 'pickpockets' of urban land, and have led to a spate of slum demolitions across the country. This book argues that in this context, it has become vital to distinguish between illegality and informality since it is those 'illegal' slums which are at the receiving end of a 'force of law', where law is violently encountered within everyday spaces. This book uses a gendered intersectional lens to explore how a 'violence of law' shapes how 'public' subjectivities of gender, class, religion and caste are encountered and negotiated within the 'private' spaces of home, family and neighbourhood. This book suggests that resettlement is not a condition that squatters desire; rather something that is seen as the only way out of the 'illegal' city. The wait for resettlement is a temporal space of anxiety and uncertainty, where particular kinds of politics around law, space and gender takes shape, which transform squatters' relations with the state, urban development, civil society, and with each other. Through their everyday struggles around water, sanitation, social and political organisation and the transformation of their homes and families, this book shows that the desire for the 'legal city' is also the irony and utopia of home, which will remain an incomplete gendered project - both for the state and for squatters.

This book is a legal and political intervention into a contemporary debate concerning the appropriateness of sexual offence prosecutions brought against young gender non-conforming people for so-called ‘gender identity fraud'. It comes down squarely against prosecution. To that end, it offers a series of principled objections based both on liberal principles, and arguments derived from queer and feminist theories. Thus prosecution will be challenged as criminal law overreach and as a spectacular example of legal inconsistency, but also as indicative of a failure to grasp the complexity of sexual desire and its disavowal. In particular, the book will think through the concepts of consent, harm and deception and their legal application to these specific forms of intimacy. In doing so, it will reveal how cisnormativity frames the legal interpretation of each and how this serves to preclude more marginal perspectives. Beyond law, the book takes up the ethical challenge of the non-disclosure of gender history. Rather than dwelling on this omission, it argues that we ought to focus on a cisgender demand to know as the proper object of ethical inquiry. Finally, and as an act of legal and ethical re-imagination, the book offers a queer counter-judgment to R v McNally, the only case involving a gender non-conforming defendant, so far, to have come before the Court of Appeal.
