La neutralité de l’Internet requiert de garantir aux usagers un accès égal à tous les services et contenus en ligne. En pratique, la gestion du trafic oblige les opérateurs à différencier certains paquets d’information circulant sur les réseaux, par exemple pour lutter contre les messages indésirables. Parfois le traitement différencié des contenus engendre des discriminations non justifiées. Ainsi, en est-il si un opérateur en place dégrade un service concurrent de téléphonie sur Internet, tel que Skype. Le droit de la concurrence permet a priori de sanctionner un tel comportement anti-concurrentiel. Mais cela suffit-il à assurer la neutralité des réseaux ? Par ailleurs, l’augmentation rapide du trafic et l’ampleur des investissements à faire dans les infrastructures du futur incitent les opérateurs à limiter les débits de base, tout en garantissant la qualité de services spécialisés, par exemple de vidéoconférence. Cette différenciation des offres a un prix. On s’éloigne du principe originel de l’Internet qui veut que toutes les communications soient traitées de la même manière. Depuis quelques années, des académiques et pionniers de l’Internet dénoncent le risque d’un Internet « à plusieurs vitesses ». Aujourd’hui, les voix des consommateurs se font entendre. Faut-il adopter une législation spécifique ? Le cadre actuel des télécommunications en Europe suffit-il pour garantir la neutralité ? Mais d’abord, comment définir la neutralité de l’Internet ? Telles sont quelques-unes des questions que cet ouvrage examine à un moment où la neutralité de l’Internet revient dans l’actualité. En juin 2013, la Commission européenne a en effet affiché sa volonté de légiférer en la matière. Le présent recueil de contributions vient donc à point nommé. This book summarizes the state of discussions regarding net neutrality in Europe. It comes at the time the European Commission intends to legislate to guarantee the right of all citizens to access the open Internet. Net neutrality is not only about how to ensure the fundamental right to receive and impart online information. The rules on the protection of consumers, by fostering transparency, also contribute to Internet neutrality and openness. Similarly competition law prohibits anti-competitive discrimination, including in Internet communications. Net neutrality thus appears at the juncture of various areas of the law. The contributions of this book compare the merits of various forms of regulation and discuss the policy dimensions of the net neutrality debate.

If we can speak of the European Community's 'economic constitution', we can assert that competition rules, together with free movement rules, form its core. Notably, implementation of the competition rules enshrined in Articles 81 and 82 EC changed radically with the enactment of Regulation 1/2003, which in effect dispensed with mandatory prior notifications and allowed national authorities to apply Article 101(3) TFEU directly. Given that national legislations perceive certain types of unilateral conduct, even if adopted by a non-dominant undertaking, as a potential source of anticompetitive effects, an important question concerns the leeway enjoyed by national authorities under the exception to the convergence rule in Article 3(2) of Regulation 1/2003, and the consequent effect on both legal practice and policy issues. In this lucidly argued book, focusing on national competition provisions in Germany, France, Italy, and the United Kingdom that deal with such conduct, the author provides a detailed examination of how such considerations as the following are affected by Regulation 1/2003: - prohibition of abuse of economic dependence or superior bargaining power; - the particular susceptibility of long-term contracts; - prohibition of resale at a loss or below cost; - prohibition of boycott, unlawful pressures, threats, and other coercive tactics adopted by undertakings; and - the role of unfair competition law. The analysis follows a functional method of comparative legal analysis, reviewing the most relevant norms in the selected jurisdictions, particularly in what concerns their goals and function in the context of their respective legal systems. Special attention is paid to two specific sectors – the motor-vehicle and the retailing industries – which have most often triggered relevant legislation and case law in the jurisdictions covered. Legal scholarship in the field is also drawn upon. In its clarification of the meaning of Regulation 1/2003, this book allows practitioners to fully grasp its scope. The author's thorough, masterful analysis of the statutory framework of Article 3 of the regulation also reveals the variety of reasons why different Member States have different competition policies on the scope of the exception to the rule of convergence, and in this way provides lawyers, policymakers, and academics with welcome insights on how major EU jurisdictions apply European competition law.

Throughout comparative administrative law there is a concept that is not unequivocally labelled: public power, administrative power or public function. Nor is its semantic load the same in each legal system. This is why it is so difficult to translate it into English, as reflected in the title of this monograph. Nevertheless, in different legal systems this term is of increasing importance in determining the scope of application of administrative law: it is used to identify bodies, tasks or functions that must be subject to specific rules of application and control, laid down by administrative law; in some cases, regarding relationships between privates. This monograph analyses the concept of administrative public power in several European legal systems: firstly, to know the scope of the concept in each legal system, and secondly, to see how it operates as a criterion for the application of administrative law. Although it may seem a conceptual and strictly academic subject, this book is very relevant for the interpretation and practical application of the law, due to the consequences that the concept of public administrative power has for delimiting the legal regime of many activities, both in the public and private sectors.

This is the thirteenth in a series on EU Competition Law and Policy produced under the auspices of the Robert Schuman Centre of the European University Institute in Florence. This publication provides an unparalleled comparative analysis of two "hot topics" in the field of antitrust and unfair competition law with regard to a number of key countries.
