Dans la vie, le juriste s'avance le code à la main. Voilà ce qu'une philosophie pragmatique du droit devrait retenir pour sujet. II s'avance " la loi dit que" à la bouche. Voilà ce qu'une philosophie réaliste du droit aurait à interroger. Comment en est-on venu à penser que c'est la loi elle-même qui parle, au-delà de sa matérialité d'encre et de papier? C'est ce raccourci de la pensée - approximation indispensable à un droit diligent - qu'instituent la codification et son prolongement doctrinal, le "légalisme" prônant, en théorie, la réduction du droit à la seule loi, de laquelle se déduiraient les solutions de tous les cas. Placé "en situation", ce raccourci du code s'avère trop schématique: comment passer de la loi générale et abstraite au cas singulier et concret? Comment traiter des notions à contenu variable, open textures (telles "le juge appréciera..."; "intérêt prépondérant"; "équitables"; "raisonnablement", "ordre public"; etc.) qui se multiplient et dont aucune méthode ne permet de prévoir le contenu? Et que penser quand cette incertitude est posée, par réalisme, au principe même de la loi, à l'image du principe de précaution requérant d'"agir en contexte d'incertitude", suivant la définition antique de la prudence? Qu'advient-il des méthodes d'interprétation dès lors que le Tribunal fédéral suisse affirme qu'il n'est point d'ordre entre elles, que les jugements de valeurs sous-tendant le but l'emportent - manière de "jugement d'équité"? La philosophie du "droit en situation" regarde à cette pratique juridique, y découvre moins les signes d'une science que d'un art, d'un dialogue argumenté entre acteurs du phénomène juridique, esquissant un changement de paradigme, une montée en complexité du droit. Après s'être posé la question "Comment en est-on venu là?" et en avoir montré les principaux ressorts philosophiques (Partie I), le juriste-philosophe du droit se demandera "Comment fait-on maintenant?" (Partie II), face à l'inflation des lois, à la déflation des valeurs et à la constante "demande de justice", lesquelles engagent le raisonnement juridique à davantage de souplesse, vers un droit prudentiel.
