Las comunicaciones entre el abogado y su cliente se caracterizan por la confidencialidad, que reclama una estricta protección constitucional, pues son un elemento esencial del derecho a la asistencia letrada y del derecho de defensa en el proceso penal. El secreto profesional de los abogados está regulado por las leyes penales y procesales, y por la normativa sobre la abogacía. Hoy, sin embargo, esa tutela normativa puede resultar insuficiente, entre otras razones por la posibilidad de acceso e incautación masiva de archivos informáticos sin que exista un mecanismo adecuado para filtrar las comunicaciones y documentos protegidos por el secreto profesional. Se hace por ello necesario reconsiderar la protección de este importantísimo aspecto de la relación abogado-cliente, tanto en la investigación penal como en las investigaciones internas en el ámbito del compliance. El presente volumen aborda algunas de las cuestiones más relevantes en materia de confidencialidad de las comunicaciones abogado-cliente. Partiendo del estudio de la jurisprudencia internacional y española, se intenta arrojar luz sobre el alcance de la protección del lawyer-client privilege en el ámbito del compliance, señalando los riesgos que puede implicar para el derecho de defensa transferir el resultado de las investigaciones internas al ámbito de la justicia penal.

La COVID-19 y la crisis derivada de la pandemia han afectado a casi todos los sectores de nuestra sociedad, el ejercicio de la abogacía no ha sido la excepción. Este trabajo —el futuro de la abogacía ante la transformación digital—, ha sido elaborado por una serie de juristas expertos de distintas áreas del ordenamiento jurídico. La obra pretende contribuir a las necesidades de la era postpandemica en el ejercicio de la abogacía. En la primera parte del trabajo, se expone una serie de temas relacionados con la trasformación digital y la abogacía. Al respecto, se analizan, entre otros temas, la asistencia jurídica a través de whatsapp, el empoderamiento del arbitraje y las nuevas perspectivas en el ejercicio de la profesión del abogado. En la segunda parte de esta obra colectiva, se contiene un estudio sobre los retos del futuro en la profesión de abogado. Sobre ello, se revisan temas como la comunicación y la relación entre el abogado y el cliente, los principios y las garantías del proceso judicial en entornos digitales, los métodos autocompositivos de la resolución de conflictos y sus efectos jurídicos, el rol del oficial de cumplimiento y la diligencia debida en la era digital, el reto de la abogacía en la defensa del medio ambiente; y la interpretación jurisprudencial de la custodia compartida en entornos digitales. Finalmente, en la tercera parte del trabajo, se expone una serie de temas relacionados con la era postcovid en el ejercicio de la abogacía. Para ello, se analizan tópicos como el arraigo de la digitalización y su afectación a los derechos fundamentales en la era post-covid, el fundamento y los límites en los deberes de solidaridad en tiempos de pandemia, los nuevos escenarios la actuación criminal en el contexto de la crisis derivada del covid, y criterios para determinar la custodia de los hijos en tiempos de covid-19. Como puede verse, este trabajo tiene la pretensión de aportar —en mayor o menor medida—, a los nuevos retos de la abogacía a la altura de los tiempos.
