Decisiveness and Fear of Disorder examines how democratic representatives make decisions in crisis situations. By analyzing parliamentary asylum debates from Germany’s Asylum Compromise in 1992-1993 and the 2015-2016 refugee crisis, Julius Rogenhofer identifies representatives’ ability to project decisiveness as a crucial determinant for whether the rights and demands of irregular migrants were adequately considered in democratic decision-making. Both crisis situations showcase an emotive dimension to the parliamentary meaning-making process. As politicians confront fears of social and political disorder, they focus on appearing decisive in the eyes of the public and fellow representatives, even at the expense of human rights considerations and inclusive deliberation processes. Rogenhofer shows how his theoretical approach allows us to reinterpret a range of crisis situations beyond the irregular migration context, including democracies’ initial responses to Covid-19, the European Sovereign Debt Crisis, and United States climate politics. These additional case studies help position concerns with decisiveness amid the challenges that populism and technocracy increasingly pose to representative democracies.

This open access book provides an alternative theoretical framework of irregular migration that allows to overcome many of the contradictions and theoretical impasses displayed by the majority of approaches in current literature. The analytical framework allows moving from an interpretation biased by methodological nationalism, to a more general systemic interpretation. It explains irregular migration as a structural phenomenon or contemporary society, and why state policies are greatly ineffective in their attempt to control irregular migration. It also explains irregular migration as a diversified phenomenon that relates to the social characteristics of the context, and why states accept irregular migrants. By providing new comparative, empirical, qualitative material which allows to start filling an evident gap in the current research on irregular migration, this book is of interest to graduate students, scholars and policy makers.

This thesis examines phenomenon of illegal large-scale migration in Central Europe after the 1989 when the world communist system was disintegrated. Large-scale illegal migration appeared as one of side effects of the development towards democracy and free market economy. This thesis identifies impact of different policies in areas of the legal and social environment, humanitarian aid and international development aid as well as measures in the area of international politics related to large-scale migration. Identification of solutions in terms of cost-effectiveness and political acceptability is one of conditions identified for future enlargement of European structures, especially adaptation of Central European countries by the European Union. Based on its nature, large-scale migration raise a number of challenges for public policy: refugee support and administration, crime control, labor market regulation with respect to the foreign labor force, and integration of increasingly diverse categories of migrants. The social and economic conditions of the transit countries such as the Czech Republic create favorable environment for migrants coming from East European and developing countries. However, there is still no successful and comprehensive official policy because of lack of experience of the Central European governments with migration, which has still more transit rather than immigration character.

In The Ethics of Immigration, Joseph Carens synthesizes a lifetime of work to explore and illuminate one of the most pressing issues of our time. Immigration poses practical problems for western democracies and also challenges the ways in which people in democracies think about citizenship and belonging, about rights and responsibilities, and about freedom and equality. Carens begins by focusing on current immigration controversies in North America and Europe about access to citizenship, the integration of immigrants, temporary workers, irregular migrants and the admission of family members and refugees. Working within the moral framework provided by liberal democratic values, he argues that some of the practices of democratic states in these areas are morally defensible, while others need to be reformed. In this essay, I will consider how law, religion, and democratic pluralism revolve around a particular issue: global migration. I use the term "global migration" to encompass a number of related issues that are often collapsed under the term "immigration." In nations that have constructed their identities around waves of settlers or migrants -- places like the United States, Canada, Australia, and New Zealand -- immigration involves the formal reception of foreigners into the host country as potential new citizens. This is just one part of the migration of peoples around the globe. Migration also encompasses emigration, asylum, economic migration,and undocumented or irregular immigration. This larger collection of human movements presents new challenges to democratic nations in a global environment in which most have explicitly committed themselves to certain fundamental, democratic values and human rights norms. Furthermore, these same values relate closely to core notions of Christianity. Catholic social teaching is a tradition within Christianity that emphasizes the dignity of the human person and, as such, complements and supports key liberal values essential to democracy and modern human rights discourse.
