Pauline studies are in a conundrum. The Reformation perspectives championed by great men like Martin Luther and John Calvin have been challenged recently by the rise of the new perspective on Paul. The main point of contention seems to be the place of biblical law in salvation. While the Reformation perspectives, based in part on Paul's apparent attacks on law, assert that salvation is a free gift unmerited by human works, the new perspective suggests the law is an integral part of the work of salvation. It holds that Paul's attacks on the law were focused only on specific aspects of law, the so-called boundary markers. This book, while having points of contact with both outlooks, takes a different view on Paul and the law. Building on Paul's self-identification as a Christian, and Christian views on the covenant, it endeavors to give biblical law its due place in the plan of salvation and the life of the believer.

Over a hundred years ago, Wellhausen's revolutionary aim in his "Prolegomena" was to prove that the Priestly legal sections of the Pentateuch reflect postexilic Judaism and must be considered a deviation from the prophetic religion which preceded it. The present study points out the biased assumptions underlying Wellhausen's theory and the fallacies in this thesis. A strong case is made for the antiquity of the Priestly Code and its antedating the Book of Deuteronomy in light of many parallels between the Priestly Law and ritual texts from the Ancient Near East, and an examination of the mythic outlook in P which distinguishes it from both Deuteronomy and Second Isaiah.

This book presents a human rights-based assessment of the various modes of state religion identification and of the various forms of state practice that characterize these different state religion models. This book makes a case for the recognition of a state duty to remain impartial with respect to religion or belief in all regards so as to comply with people s fundamental right to be governed, at all times, in a religiously neutral manner. As this book demonstrates through the various case studies there is increasing interest and concern at the manner in which questions concerning the enjoyment of the right to the freedom of religion or belief bear upon key questions concerning the governance of democratic society. Issues raised involve matters concerning employment, education, expression, association and, more generally, the interface between religion and political life. The existing literature often traces these concerns back to the need to consider the place of religion in contemporary society but leaves matters there. Another body of academic literature explores the theoretical dimensions of that relationship but fails to connect it to the practice of states in order to test out the propositions which are the product of these reflections. The great virtue of this work is that is seeks to unite these various enterprises and engages head on with the challenges which this produces The aim is to demonstrate and illustrate the key contention: that there is an emergent right to religiously neutral governance, and that this is incompatible with the continuation of systems which offer preference to particular forms of belief system religious or otherwise. A chief virtue of this book is that it works through the consequences of this claim in a fearless fashion, posing challenges for those states which continue to use their legal frameworks to offer support (directly or indirectly) for historical, dominant or favoured forms of religion or belief. Law and Faith in a Sceptical Age is an analysis of the legal position of religious believers in a dominantly secular society. Great Britain is a society based upon broadly liberal principles. It claims to recognise the needs of religious believers and to protect them from discrimination. But whilst its secular ideology pervades public discourse, the vestigial remains of a Christian, Protestant past are seen in things as varied as the structure of public holidays and the continued existence of established churches in both England and Scotland. Religious, Christian values also form the starting point for legal rules relating to matters such as marriage. Active religious communities constitute a very small minority of the population; however, those who belong to them often see their religion as being the most important element of their identity. Yet the world-view of these communities is frequently at odds with both the prevailing liberal, secular climate of Great Britain and its Christian, Anglican past. This necessarily entails a clash of ideologies that puts in question the secular majority's claim to want to protect religious minorities, the possibility of it being able to sufficiently understand the needs of those minorities and the desirability or practicality of any accommodation between the needs of the various religious communities and the secular mainstream of society. Law and Faith in a Sceptical Age addresses these issues by raising the question of whether a liberal, secular state can protect religion. Accommodation to different religious traditions forms part of the history of the legal systems of Britain. This book asks whether further accommodation can and should be made.
