Während sich derartige Angebote immer mehr verbreiten, drängt sich die Frage nach deren rechtlicher Zulässigkeit im Hinblick auf urheber- sowie datenschutzrechtliche Aspekte auf. In der Arbeit wird zunächst geklärt, welche E-Learning-Angebote unter den urheberrechtlichen Werkbegriff fallen, bevor auf die Rechte des Urhebers sowie gesetzliche und vertragliche Zugriffsrechte, die die Rechte speziell im E-Learning einschränken, eingegangen wird. Danach wird geklärt, welche Sanktionen und andere Rechtsfolgen der E-Learning-Betreiber bei mangelnder Beachtung des Urheberrechts befürchten muss. Hinsichtlich der datenschutzrechtlichen Problematik wird das anzuwendende Rechtsregime festgelegt, bevor die Datenerhebung innerhalb einer Lernplattform auf ihre Zulässigkeit untersucht wird. Zuletzt wendet sich die Autorin der Frage nach den Rechtsfolgen bei mangelhaftem Datenschutz zu. Dargestellt wird die Thematik exemplarisch anhand des E-Learning-Angebots einer bayerischen Hochschule.
