The past forty years have seen a wide proliferation of an extensive range of disputes under international law concerning cultural heritage. These disputes can concern a disparate variety of issues. A substantial number of have concerned the restitution of stolen and illegally exported art objects. Another set of controversies has involved the protection of immovable cultural heritage. Unlike other fields of international law, international cultural heritage law does not have an ad hoc mechanism of dispute settlement. As a result, controversies are to be settled through negotiation or, if this fails, through existing dispute resolution means, which include arbitration and litigation before domestic courts or international tribunals. This ad hoc fashion of dealing with disputes is not without consequences. The most serious problem is that the same or similar cases may be settled in different ways, thereby bringing about an incoherent and fragmentary enforcement of the law. This book offers a comprehensive and innovative analysis of the settlement of cultural heritage disputes. It addresses the means the potential fragmentation can be resolved by providing a two-fold analysis. First, it provides a detailed analysis of the existing legal framework and the available means of judicial and non-judicial dispute settlement. Second, it explores the feasibility of two solutions for overcoming the lack of a specialized forum. The first potential solution is the establishment of a new international court. The second concerns existing judicial and extra-judicial fora and means of increasing interaction between them by the practice of 'cross-fertilization'. The book focuses on the substance of such interaction, and identifies a number of culturally-sensitive parameters which need to apply (the 'common rules of adjudication'). Ultimately the book argues that existing judicial and non-judicial fora should adopt a cross-fertilizing perspective to use and disseminate jurisprudence containing these common rules of adjudication, to enhance the effectiveness and coherence of their decision-making processes. Finally, it sets out how such an approach would be conducive to the development of a wider body of international cultural heritage law.

This dissertation presents four methodological case studies that elaborate on the results of two field survey projects (the Astura and Nettuno surveys) that were carried out by the Groningen Institute of Archaeology (GIA). The case studies aim at investigating biasing factors that limit the analytical and comparative value of data from archaeological survey in general using these two projects as a suitable testing ground. Both surveys, carried out between 2003 and 2005, fell within the ambit of the Pontine Region Project (PRP), a long-term research program aimed at the diachronic archaeological investigation of the various landscape units forming this region. They covered two contiguous areas, situated on the Tyrrhenian seaboard, approximately 60 kilometres south of Rome. The study area comprises the communal area of the modern town of Nettuno, as well as the lower valleys of the Astura and Moscarello rivers (see fig. 0.1).2 As such it incorporates parts of the hinterland of the ancient towns of Antium and Satricum. In chronological terms this dissertation considers a time-span of 1300 years, from the 6th century BC to the 7th century AD.

When America began to emerge as a world power at the end of the nineteenth century, Italy was a young nation, recently unified. The technological advances brought about by electricity and the combustion engine were vastly speeding up the capacity of news, ideas, and artefacts to travel internationally. Furthermore, improved literacy and social reforms had produced an Italian working class with increased time, money, and education. At the turn of the century, if Italy's ruling elite continued the tradition of viewing Paris as a model of sophistication and good taste, millions of lowly-educated Italians began to dream of America, and many bought a transatlantic ticket to migrate there. By the 1920s, Italians were encountering America through Hollywood films and, thanks to illustrated magazines, they were mesmerised by the sight of Manhattan's futuristic skyline and by news of American lifestyle. This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. For many different reasons, speakers borrow words from other languages to fill gaps in their own lexical inventory. The past ten years have been characterized by a great interest among phonologists in the issue of how the nativization of loanwords occurs. The general feeling is that loanword nativization provides a direct window for observing how acoustic cues are categorized in terms of the distinctive features relevant to the L1 phonological system as well as for studying L1 phonological processes in action and thus to the true synchronic phonology of L1.
