Luigi Ferrajoli es sin duda el teórico del derecho que, después de Hans Kelsen y de Norberto Bobbio, mayores energías intelectuales ha dedicado a la reflexión filosófica sobre la democracia. El objeto de esa reflexión, contenida en su intensa producción científica y sistematizada en Principia iuris , es la peculiar forma de democracia establecida en los principales países de la Europa continental de la segunda posguerra. Pero, a diferencia de la obra de Kelsen y de Bobbio, en la de Ferrajoli la teoría de la democracia se encuentra estrechamente conectada con la teoría del derecho, de la que toma el léxico y las categorías. Es una teoría jurídica de la democracia, centrada en destacar el carácter diferencial de los actuales ordenamientos constitucionales: el posicionamiento en el vértice del sistema normativo de constituciones rígidas, garantizadas por medio de órganos jurisdiccionales encargados de sancionar sus violaciones. El problema de la validez de las normas jurídicas adquiere así una relevancia central en la construcción teórica del paradigma normativo de la democracia constitucional. Los textos reunidos en este volumen se organizan en los tres ejes principales de "Constitucionalismo y democracia", "Derechos y bienes fundamentales" y "Libertad e igualdad". Concluyen, así pues, con la valoración de los iura paria (según la expresión ciceroniana), de esos "derechos iguales" que son los derechos fundamentales que todos tienen en común y que determinan la pertenencia a una misma comunidad política.
