This book examines the genesis of poverty in Jamaica and how policies and laws related to social and economic rights can help with the promotion and protection of human rights as part of a broader worldview of human dignity. It sets out through the policy lenses of the New Haven School of Jurisprudence to understand how Jamaica can fulfil these obligations in a meaningful way to impact the daily lives of its people. Through a historical survey to the present-day Jamaica, the exploration uses the theoretical frame of the New Haven School of Jurisprudence which underscores human dignity as being paramount to the attainment of human progress and development. The trajectory of the modern human rights movement and constitutional apparatus of nation states help to reinforce and entrench the ways, standards and norms relating to social and economic rights are observed. This, too, is a consideration for this small island state in the Northern Caribbean. However, the jurisprudential question is how the interpretation of laws, and the implementation of policies can be synchronized as conditioning factors of a global consensus on human dignity especially for the most vulnerable. Socio economic rights underscore a public morality though their potential enforcement is often criticized as too vague and imprecise for lasting or meaningful effect. The New Haven School of Jurisprudence with its emphasis on human dignity in the world community points to a new approach to the egregious human rights violations caused by poverty and the part played by these second-generation rights. The book combines academic rigor with substantial hands-on legal experience, and will be of interest to scholars, practitioners, and policymakers focused on human rights in the region.

This paper examines the causes, processes, and outcomes of the two Belize sovereign debt restructurings in 2006–07 and in 2012–13 that occurred outside of an IMF-supported program. It finds that the motivation for the two debt restructurings differed, as the former was driven by external liquidity concerns while the latter was motivated by a substantial increase in the coupon rates and future fiscal solvency concerns. Despite differential treatment between residents and non-residents, both 2006–07 and 2012–13 debt exchanges were executed through collaborative engagement, due in part to the existence of a broad-based creditor committee and the authorities’ effective communication strategy. However, while providing temporary liquidity relief, neither of the debt restructurings properly addressed long-term debt sustainability concerns. Going forward, the success of the 2012–13 debt restructuring will still depend on the country’s ability to strengthen fiscal efforts and public debt management framework.

Abstract: This paper analyzes the recent growth of government domestic debt, including central bank debt, using a new data base on government domestic debt in developing countries with large, open financial systems. On average, government domestic debt grew much faster than GDP between 1994 and 2004 and became larger than foreign debt. The rapid growth of domestic debt reflects financial crises, the growth of central bank debt and the greater attractiveness to governments of issuing domestic debt as well as the recent increase in demands for it. Both its attractiveness and the increased demands for it reflect the current benign international environment to some degree. The main risk of government debt, domestic or foreign, remains its overall size relative to a country's fiscal, financial, and political institutions. While government domestic debt can help the domestic private capital market, large domestic debt, like large external debt, has risks. For example, there can be "sudden stops" in the demand for domestic debt as well as in foreign lending. Governments need to be aware of the risks and burdens in domestic debt issue-crowding out small borrowers, transferring risks to banks when issuing longer maturity, fixed-interest domestic debt and reducing returns, and imposing risks on holders of pensions, annuities, and life insurance policies. Growth of central bank debt can divert central banks from pursuit of the objective of price stability.
