Jahrhunderts, Note: 10, Philipps-Universität Marburg (Gesellschaftswissenschaften und Philosophie), Veranstaltung: Politische Theorien der Moderne, Sprache: Deutsch, Abstract: In meiner Hausarbeit werden ich auf die „Theorie der Gerechtigkeit“ von John Rawls eingehen. Dabei werde ich zunächst eine kurze Biographie John Rawls darstellen, bevor ich auf die Theorie selbst eingehe. Danach werd ich die kommunitaristische Kritik an der universalistischen Moralbegründung Rawls darlegen. Der amerikanische Philosoph John Rawls hat in seiner „Theorie der Gerechtigkeit“ die Verbindung zwischen dem kaum fassbaren Begriff der Gerechtigkeit und einem Konsensurteil, das nicht von einem, sondern von allen getroffen wird, systematisch untersucht. Grundlage dieser Theorie sind zwei Gerechtigkeitsprinzipien, anhand derer man ebenso gut wie mit einer öffentlichen Beratung, feststellen können soll, ob etwas gerecht ist oder nicht. Um die Kritikpunkte der Kommunitaristen zu verstehen, werde ich auf die Grundlage der beiden Prinzipien, die mit den Begriffen wie „Grundgüter“, „Urzustand“ und „Schleier des Unwissens“ bezeichnet werden, eingehen. Nach diesem Schritt trage ich verschiedene Kritikpunkte der Kommunitaristen zusammen. Obwohl ich der Meinung bin, dass die Kritik, die die Kommunitaristen vorgebracht haben, nicht in der Lage sind, Rawls Theorie zu widerlegen, glaube ich dass die kommunitaristischen Argumente sehr ernst genommen werden müssen. Bei der Kritik an Rawls, werde ich besonders auf die kommunitaristische Kritik an der universalistischen Moralbegründung eingehen. Hierbei findet vor allem die Argumentation gegen die universalistische Moralauffassung von Michael Walzer aus seinem Werk „Kritik und Gemeinsinn“ Beachtung. [...]

This book examines the conception of the person at work in John Rawls’s writings from Theory of Justice to Justice as Fairness: A Restatement. The book aims to show that objections to Rawls’s political conception of the person fail and that a Rawlsian conception of political identity is defensible. The book shows that the debate between liberals and communitarians is relevant to the current debate regarding perfectionism and neutrality in politics, and clarifies the debate between Rawls and communitarians in a way that will promote fruitful discussion on the issue of political identity. It does this by providing a clearer account of a conception of personal identity according to which persons are socially constituted, including the intuitions and assumptions underlying the communitarians’ conception of persons as “socially constituted.” It examines the communitarian objections to liberal political theory and to the liberal conception of persons, the “unencumbered self.” The book differentiates between two types of objection to the liberal conception of persons: the metaphysical and normative. It explains Rawls's political conception of persons, and the metaphysical and normative commitments Rawls incurs—and does not incur—in virtue of that conception. It shows that both kind of objection to Rawls's political conception of the person fail. Finally, modifying Rawls’s political conception of the person, a Rawlsian conception of political identity is explained and defended.

Die Interdependenz von Handeln und politischer Welt - ein zentraler Gedanke Hannah Arendts, der die Untersuchung leitet - ist das Spielfeld für die Rückgewinnung der konkreten Dimension des politischen Handelns. Den Ausgangspunkt bildet die politische Freiheit, wie sie sich unter Rekurs auf Alltagserfahrungen zeigt und mithin erfahrbar wird. Im Fortgang der Darstellung werden die Züge des Handelns im Sinne Hannah Arendts immer wieder mit den Absichten der nicht phänomenologischen Autoren konfrontiert, wobei deutlich wird, inwiefern sie die Phänomene des Handelns und die Erfahrbarkeit politischer Freiheit sehen oder verfehlen. Der Schauspielcharakter des Handelns, die Frage nach Sein und Schein und die Ästhetik der Lüge führen zu einer an Hannah Arendt anschließenden originellen eigenen Beschreibung der Urteilskraft, die im Interdependenzgefüge von Handeln und politischer Welt und in Auseinandersetzung mit Kants einschlägigen Paragraphen aus der Kritik der Urteilskraft aufscheint. In Fortführung Arendtscher Ansätze zeigt die Autorin, dass Hannah Arendt der Urteilskraft einen politischen Charakter zuerkannt hätte, wenn sie noch zur Ausführung ihrer Gedanken zum Urteilen gekommen wäre. Die Durchmusterung der Phänomene des Handelns und der verschiedenen Möglichkeiten des Urteilens lässt bisher so nicht gesehene Bezüge zutage treten.
