Die Studie rekonstruiert die Entstehung der europäischen Rechtswissenschaft im 12. Jahrhundert als einen Prozess gesellschaftlicher Differenzierung und geht dann der Positivierung des Rechts als einem – bis heute unabgeschlossenen – Prozess der Differenzierung von Recht und Rechtswissenschaft nach. Diese Differenzierung findet im 19. Jahrhundert ihren Ausdruck in der Umstellung des Rechts auf den Begriff der Geltung. Wesentliche Stationen auf diesem Differenzierungsweg waren der Anspruch politischer Akteure, das Recht im Wege der Gesetzgebung zu kontrollieren; die Selbstbeschreibung des gelehrten Rechts als Produkt seiner Rechtswissenschaft im usus modernus; und die Schließung des Rechtssystems durch die Verfassungen des langen 19. Jahrhunderts und die darauf bezogene Verfassungsjudikatur.
