Bij gebiedsontwikkeling is sprake van een gecombineerde ontwikkeling van één of meer functies, mede in relatie tot het omliggende openbare gebied. De essentie van gebiedsontwikkeling is het integrale karakter van de opgave, ongeacht de schaal waarop de ontwikkeling plaatsvindt. Gebiedsontwikkeling is daarmee een verzamelnaam voor vele typen ruimtelijke veranderingsprocessen ten behoeve van onder meer woningbouw, bedrijventerreinen, natuur en agrarische functies. De afgelopen jaren is het karakter van gebiedsontwikkeling op veel plaatsen ingrijpend veranderd. Waar in het verleden een grootschalige aanpak en een hoog ‘blauwdrukkarakter’ van veel plannen kenmerkend waren, wordt nu veel meer rekening gehouden met toekomstige onzekerheden. Ook is het zwaartepunt van de gebiedsontwikkelingsopgave verschoven van uitleglocaties naar locaties binnen het bestaande bebouwde gebied. Bij gebiedsontwikkeling vraagt een aantal aspecten voortdurend de aandacht zoals de verhouding tussen het publiekrecht en het privaatrecht, een juiste en doelmatige planologische inkadering, aanbestedingsrechtelijke kwesties, staatssteun, fiscale aspecten en het omgaan met risico’s. Voor de doelgroep beoogt het Handboek een gedegen theoretische basis op deze onderwerpen aan te reiken, alsmede inspiratie te verschaffen uit de beschreven actuele voorbeelden van gebiedsontwikkeling. Dit ‘Juridisch Handboek Gebiedsontwikkeling’ is niet alleen bedoeld voor het onderwijs, maar biedt ook een handreiking aan hen die werkzaam zijn bij publieke of private partijen alsmede hun externe adviseurs die te maken hebben met gebiedsontwikkeling. Dit kan zowel op projectniveau zijn als vanuit een bestuurlijke verantwoordelijkheid.

Het publiekrechtelijk bouwrecht, beter gezegd: het omgevingsrecht, is voortdurend in beweging. De grote ontwikkeling in het omgevingsrecht is de Omgevingswet. De wet vormt een enorme stimulans van het denken over de fysieke leefomgeving in brede zin, en zorgt voor integratie van verschillende omgevingsrechtelijke domeinen zoals ruimte, milieu, water en grondbeleid. De contouren van de wet worden steeds meer duidelijk nu (herziene) voorstellen voor amvb’s, aanvullingswetten en een invoeringswet het licht zien. Het proces is echter voorlopig nog niet afgerond, waardoor het toekomstige omgevingsrecht voortdurend in beweging zal zijn. Het bestaande omgevingsrecht is evenmin een rustig bezit is. Te wijzen is op recente wetswijzigingen, zoals de implementatie van de herziene MER-richtlijn, de aangepaste Ladder voor duurzame verstedelijking, nieuwe tranches die worden toegevoegd aan het Besluit uitvoering Crisis- en herstelwet alsmede het voortdurend verschijnen van nieuwe jurisprudentie. Daarnaast hebben bredere ontwikkelingen, zoals een aantrekkende woningmarkt, het vergroten van mobiliteit en de duurzaamheidstransitie hun weerslag op oplossingen die gevonden moeten worden binnen het omgevingsrecht. Dit Handboek neemt het huidige omgevingsrecht als uitgangspunt en beschrijft tegelijk op basis van de actueel beschikbare informatie uit het wetgevingsproces hoe de regelgeving (voor de verschillende te behandelen onderwerpen) zal luiden na inwerkingtreding van de Omgevingswet. Kortom: een ‘Handboek Bouwen op weg naar de Omgevingswet’. Dit boek is bedoeld voor een ieder die zich met het omgevingsrecht bezig houdt, zowel binnen onderwijs als de (bouw)praktijk. Nadrukkelijk uitgangspunt daarbij is om de lezer mee te nemen in de transitie van het omgevingsrecht, van het ‘oude’ recht, naar het ‘nieuwe’ recht, om zo een instrument te bieden waarmee de dynamische wereld van het omgevingsrecht - nu en straks - verder ontgonnen wordt.

Migration-driven diversity means European cities are becoming increasingly superdiverse. Some European neighbourhoods have become places where newcomers arrive from across the world, speaking many different languages, from a range of socio-economic backgrounds and with diverse religious beliefs and practices, while living alongside long-established migrant and white European populations.
