Reflexiones sobre dos ideas centrales: el carácter jurisdiccional atribuido al arbitraje y las implicancias de la jurisdicción en la actividad arbitral. Este libro aborda los puntos de convergencia entre estos dos conceptos para afirmar —en contraposición a lo sostenido por el Tribunal Constitucional— que el arbitraje no es una actividad jurisdiccional, sino la expresión más intensa de la autonomía privada de partes, la misma que concurre con sus propias reglas como una alternativa a la justicia estatal. En ese sentido, el vínculo entre arbitraje y jurisdicción es tratado en esta obra desde la complementariedad de ambos conceptos y no desde la contraposición entre estos. Para ello, la jueza Marianella Ledesma revisa profundamente las nuevas perspectivas que acoge la nueva Ley General de Arbitraje sobre dicha relación y plantea ejemplos puntuales que ilustran esta situación. Esta tercera edición, ampliada y revisada, incluye un extenso anexo con extractos de resoluciones del Tribunal Constitucional que servirán como ejemplo para aplicar en futuros procesos arbitrales, resoluciones de controversias y ejecuciones del convenio arbitral.

Cuando a un procesalista se le plantea la posibilidad de tratar el tema del Arbitraje, especialmente el ARBITRAJE DE CONSUMO, lo primero que le viene a la mente es la defensa a ultranza de nuestro proceso jurisdiccional. Y este es precisamente el tema del que se ha de huir: no debemos plantearnos esa disyuntiva, ese enfrentamiento entre el “Arbitraje -general o de consumo- versus la jurisdicción ordinaria ”. Por contra, debemos respaldar la opción del Arbitraje de consumo por sus virtudes y méritos propios, no por las deficiencias y carencias de las que adolece la Administración de Justicia. El Arbitraje de consumo, si bien no es una vía nueva, permite que se obtenga justicia con mayor rapidez que acudiendo a la jurisdicción ordinaria. Lo podemos englobar dentro de las ADR en cuanto suponen una vía distinta a la jurisdicción para resolver los conflictos y mantener la paz social, sin recurrir a la fuerza. Estas vías alternativas no hay que abordarlas como enfrentadas a la justicia tradicional sino como alternativa y/o complementaria de aquella.
