Esta es la primera obra, en nuestra doctrina constitucional, que, de manera sistemática y completa, examina el neoconstitucionalismo, vinculándolo con la jurisdicción constitucional. El libro busca, en seis capítulos, proporcionar argumentos que colaboren a justificar la tesis según la cual, en sistemas nutridos por las ideas neoconstitucionalistas, no resulta coherente la presencia de regímenes concentrados de jurisdicción constitucional, sino que, al contrario, sus elementos distintivos parecen demandar la existencia de regímenes difusos o, al menos, mixtos. Se abordan a lo largo de la obra interrogantes capitales en el derecho constitucional contemporáneo: ¿Qué distingue a una Constitución de las demás fuentes formales del derecho? ¿Puede –y debido a qué fundamentos– una Carta Política auto- proclamarse como suprema? ¿Qué nexo sostiene el trinomio supremacía, reforma y garantía de las constituciones? ¿Qué soporta a la denominada supremacía constitucional, entendida como esa cualidad que ostenta una norma para generar un deber de acatamiento por parte de otras normas, lo que incluye una vocación de imponerse a aquellas en caso de conflicto, sin que sea consecuencia de los criterios cronológico o de especialidad, sino en virtud de la especial potencia normativa que se le asigna? Y, ¿qué hace que se considere válida a la primera y no a las otras?, entre otras. En palabras de su prologuista, Miguel Ángel Fernández González Profesor de Derecho Constitucional y Ministro del tribunal Constitucional: “Los contornos del contenido de la obra que el profesor Núñez incorpora a nuestra doctrina constitucional porque su lectura debe ser obligatoria para todos quienes nos dedicamos a este ámbito del derecho, si bien, realmente, tiene que ser revisada por todo abogado y jurista, ya que permite involucrarse y comprender los aspectos más decisivos de la ciencia jurídica contemporánea que ha sido transformada totalmente por las nuevas concepciones constitucionales. Teniendo como referente la Constitución Política de 1991, el derecho al medio ambiente sano, se distingue al ser considerado como un derecho colectivo de “tercera generación” pues fue el interés del constituyente derivado, en incorporar el aspecto ambiental de manera transversal en el ordenamiento superior, al estar relegado este tema en la Constitución de 1886, siendo indispensable en acatar el compromiso del reconocimiento y protección al derecho a gozar de un medio ambiente sano, asumido en la Conferencia de Estocolmo y posteriormente devino en la Declaración de Río, la necesidad de incluir un modelo de desarrollo sostenible, efectivamente, Colombia entró a la vanguardia de las otras constituciones del mundo al insertar este “nuevo derecho” en más de treinta y cuatro artículos constitucionales lo que según la Sentencia T-411/92, la ha denominado como una “Constitución ecológica, verde o ambiental”, además de ser progresista en sus pronunciamientos. Así las cosas, transitamos dentro del estudio investigativo en un análisis de temas trascendentales como: las categorías de los derechos, aspectos jurídicos legales del desarrollo del medio ambiente, las acciones constitucionales, el activismo judicial de la Corte Constitucional colombiana y luego concluir, con la jurisprudencia constitucional sobre medio ambiente sano en Colombia. Es en este contexto, donde surge el planteamiento: ¿Cómo puede un derecho de tercera generación que ha sido vulnerado y cuya vía procesal son las acciones populares, acudir a través de la acción de tutela para buscar su protección en sede judicial?. Así las cosas, el estado de la cuestión del presente estudio investigativo, se centró en analizar las diferentes tendencias adoptadas en la protección ambiental por la Corte Constitucional desde el periodo comprendido entre el 4 de julio de 1991 hasta el día 4 de agosto 2014, iniciando con la Sentencia T-403/92, y finalizando con la Sentencia T-197/14, dada la delimitación del problema de estudio elegido, que permite identificar los supuestos teóricos y jurídicos directamente relacionados con el objeto de investigación, allí se tomó una muestra representativa de 359 pronunciamientos de esa alta Corporación, enfocando nuestro análisis específicamente en las acciones de tutela, sin dejar de lado, las Sentencias de Constitucionalidad, Sentencias de Unificación y Autos, para lograr identificar cinco líneas jurisprudenciales dentro del medio ambiente sano, cuya fluctuación se dio inicialmente como un derecho fundamental, transitó a la teoría de la conexidad, siguió a tener una doble titularidad de los derechos subjetivos y colectivos, posteriormente acogió de nuevo la fundamentalidad pero bajo la preceptiva de instrumentos internacionales y finalmente indicar, la equivalencia en fundamentalidad de derechos y la transversalidad del medio ambiente con los demás derechos prestacionales.

This is the English version of Jerzy Wroblewski's major work in Polish, S~dowe Stosowania Prawa (translated in his own preferred terms as 'The Judicial Application of Law'). The present translation arose out of a visit by the author to Scotland in 1989. In that year, the Carnegie Trust for the Universities of Scotland made it possible for Jerzy Wroblewski to spend six months as a Carnegie Fellow in the Centre for Criminology and the Social and Philosophical Study of Law at the University of Edinburgh. During that time he took a notably active part in the intellectual life of the Centre and the Faculty of Law. He gave freely of his time in teaching and advising students and also produced a series of original articles on topics connected with legal reasoning and law and computers. His major task while he was here, however, was to prepare a translation of S~dowe Stosowania Prawa, and this he accomplished to the extent of completing a preliminary draft. Zenon Bankowski and Neil MacCormick were to help him in improving this linguistically and preparing the final text for publication. Wroblewski warned us, having finished his draft with great labour, that the greater labour would be in the polishing of it. For we would have, as he joked, 'to translate my English into English'. And certainly, we found it extremely time-consuming, so as to defy completion during his stay in Edinburgh.

What is law? What is it for? How should judges decide novel cases when the statutes and earlier decisions provide no clear answer? Do judges make up new law in such cases, or is there some higher law in which they discover the correct answer? Must everyone always obey the law? If not, when is a citizen morally free to disobey? A renowned philosopher enters the debate surrounding these questions. Clearly and forcefully, Ronald Dworkin argues against the “ruling” theory in Anglo-American law—legal positivism and economic utilitarianism—and asserts that individuals have legal rights beyond those explicitly laid down and that they have political and moral rights against the state that are prior to the welfare of the majority. Mr. Dworkin criticizes in detail the legal positivists’ theory of legal rights, particularly H. L. A. Hart’s well-known version of it. He then develops a new theory of adjudication, and applies it to the central and politically important issue of cases in which the Supreme Court interprets and applies the Constitution. Through an analysis of John Rawls’s theory of justice, he argues that fundamental among political rights is the right of each individual to the equal respect and concern of those who govern him. He offers a theory of compliance with the law designed not simply to answer theoretical questions about civil disobedience, but to function as a guide for citizens and officials. Finally, Professor Dworkin considers the right to liberty, often thought to rival and even preempt the fundamental right to equality. He argues that distinct individual liberties do exist, but that they derive, not from some abstract right to liberty as such, but from the right to equal concern and respect itself. He thus denies that liberty and equality are conflicting ideals. Ronald Dworkin’s theory of law and the moral conception of individual rights that underlies it have already made him one of the most influential philosophers working in this area. This is the first publication of these ideas in book form.
