A total institution is defined by Goffman as a place of residence and work where a large number of like-situated, individuals, cut off from the wider society for an appreciable period of time, together lead an enclosed, formally administered round of life. Prisons serve as a clear example, providing we appreciate that what is prison-like about prisons is found in institutions whose members have broken no laws. This volume deals with total institutions in general and, mental hospitals, in particular. The main focus is, on the world of the inmate, not the world of the staff. A chief concern is to develop a sociological version of the structure of the self. Each of the essays in this book were intended to focus on the same issue--the inmate's situation in an institutional context. Each chapter approaches the central issue from a different vantage point, each introduction drawing upon a different source in sociology and having little direct relation to the other chapters. This method of presenting material may be irksome, but it allows the reader to pursue the main theme of each paper analytically and comparatively past the point that would be allowable in chapters of an integrated book. If sociological concepts are to be treated with affection, each must be traced back to where it best applies, followed from there wherever it seems to lead, and pressed to disclose the rest of its family.

The cruel power of misdirected words, artfully structured but spiritually empty and bearing the stamp of law or legalistic reasoning, is a persistent theme in the modern novel. Richard Weisberg, who has written extensively on both literature and law, explores the role of legalism and its abuses in eight major novels of the nineteenth and twentieth centuries. Beginning with Dostoevski and moving by way of trenchant analyses of Flaubert and Camus, Weisberg culminates his argument in a brilliantly revisionist reading of Melville's Billy Budd. In each of the novels treated, Weisberg sees a verbally gifted central character relying on wordiness to avoid or distort previously revealed truths. He argues that the malaise Nietzsche called ressentiment goads these characters to verbalizations that do violence to others and, ironically, indict their very creators. He identifies the legalistic theme as the major mode of iconoclasm in modern fiction and the source of its holocaustic vision. Writers, he reflects, viewed with profound skepticism their culture's tendency to substitute complex narrative formalism for earlier, absolute approaches to justice. Não se ignora que boa parte de sua contribuição para a construção do direito romano e, portanto, para o direito ocidental, se deu pelo ensino e pela escrita de obras de doutrina, mas, neste trabalho, optou-se por apreciar essa contribuição pelo fio condutor da atividade consultiva, desdobrada em três aspectos ou tarefas, conforme a definição dada por Cícero no De Oratore: indicar os meios processuais adequados (agere), auxiliar na prática de atos jurídicos (cavere) e responder a questões jurídicas que eram colocadas por particulares ou magistrados (respondere). Desempenhando tais funções, cujas alterações ao longo da história romana são descritas no trabalho por meio do estudo cuidadoso das fontes, os juristas romanos atuaram como artífices e lapidadores de diversos institutos jurídicos, propondo soluções para casos concretos, que, uma vez aceitas, eram replicadas e se tornavam direito estabelecido (ius receptum). Com isso, contribuíram tanto para a criação de novas formas jurídicas, ou seja, para a adaptação do direito a novas necessidades, ampliando o rol de soluções e institutos jurídicos, quanto para a orientação dos atores envolvidos na prática jurídica diária, evitando que as inovações e melhorias ocorressem de forma desordenada e sem vínculo com a tradição. The referendum is not a monolithic method of national decision making. There are a multitude of referendum forms which exist under varying constitutional conditions and operate in different ways. A global comparison shows that more than half the constitutions of the world provide for the referendum at a national level, but referendums are also carried out without explicit constitutional support. Two main forms of referendum can be observed, the mandatory constitutional referendum and the policy vote. This book argues that the referendum does not undermine representative decision making, but supplements it in various ways: the referendum is not diametrically opposed to representative government, and when properly designed and used, the institution of the referendum can enhance the legitimacy of a constitutional and political system. This book is the first comprehensive constitutional and comparative analysis of the referendum. It offers illuminating and intriguing reading for all those interested in national decision making.
