Gender Justice and Legal Pluralities: Latin American and African Perspectives examines the relationship between legal pluralities and the prospects for greater gender justice in developing countries. Rather than asking whether legal pluralities are ‘good’ or ‘bad’ for women, the starting point of this volume is that legal pluralities are a social fact. Adopting a more anthropological approach to the issues of gender justice and women’s rights, it analyzes how gendered rights claims are made and responded to within a range of different cultural, social, economic and political contexts. By examining the different ways in which legal norms, instruments and discourses are being used to challenge or reinforce gendered forms of exclusion, contributing authors generate new knowledge about the dynamics at play between the contemporary contexts of legal pluralities and the struggles for gender justice. Any consideration of this relationship must, it is concluded, be located within a broader, historically informed analysis of regimes of governance.

This book expands the field of prison research by drawing on six months of unique, ethnographic research in Santa Monica prison, the largest women’s prison in Lima, Peru. Esta investigación tiene la intención de acercarnos al problema de la violencia sexual a infantes por incesto, en espacios rurales y/o indígenas nos confronta con una problemática multifactorial. Por esa complejidad, lo que se propone el planteamiento del problema, las teorías en torno a la violencia para explicar el caso de la región indígena del Totonacpan de la costa y finalmente como estrategia, una metodología de intervención social con métodos y técnicas propias de la antropología reflexiva, arteterapia, la atención plena. El proceso de esta investigación se acompañó con especialistas del Taller de Arteterapia A.C, ciudad de México. El trabajo reflexivo sobre la intervención social se llevó a cabo, bajo la asesoría de la Dra. Patricia Ravelo Blancas, del Centro de Investigación de Estudios Superiores en Antropología Social, Ciudad de México. Finalmente, en el Diplomado en Mindfulness y artes escénicas que organizó la facultad de Danza de la Universidad Veracruzana, dio la oportunidad de trabajar una semana con el Dr. Richard Davidson, investigador en neuropsicología y fundador del Centro de Investigación de Mentes Saludables en la Universidad de Wisconsin Madison.

This book examines the roots of systemic aggression against women in contemporary Mexico, and the connection between social practices and the institutional permissiveness of the Mexican State with regard to gendered violence. Since the democratic transition at the end of the 1990s, Mexico has registered an increase in the intensity and types of violence that have made life in some regions almost unsustainable. The chapters in this volume consider that capitalism, colonialism and patriarchy are interrelated processes that employ the technologies of gender and race as a continuation of the symbolic hegemony that treats feminized and racialized bodies as disposable. Against this background, it becomes necessary to understand from different dimensions the systemic violence against women as well as the processes of articulation between social practices and the permissiveness of the State in the face of aggression. Gender-Based Violence in Mexico mobilizes a dialogue between writings, fields of knowledge, causes and situations as essential tools for the struggle against gender violence. As a situated work that underlines the systematic roots of the violence that keeps women in subaltern positions, the text seeks an insurrection, an uprising of the bodies that invite naming the abject, peripheral and unseen populations of the project of globalized life, woven by the obsession of success and prestige. It presents a counter-conclusion in the manner of a beginning in the desire to elaborate counter-political and counter-pedagogical strategies of non-coercive experiences, where questions and debates are not a sign of belligerence but of vitality and care for the body-territories. Gender-Based Violence in Mexico will appeal to scholars of sociology, criminology, gender and Latin American studies with interests in gendered violence and injustice.

Over the past decades, an increasingly influential Political Philosophy approach has been seen to defend issues relating to cultural injustices. The daily struggles arising from political agendas within different societies confirm this. This perspective can be summarised using the Hegelian expression “struggle for recognition”, and it is this expression that underpins the current position of minorities members and their defenders. This means that misrecognition, disrespect, and humiliation form the base of (cultural) injustices and must be avoided. Minorities are a fundamental part of democratic societies, but their rights have not always been respected. Inmigrants are currently the object of xenophobic campaigns. Rome people, the European minority, face additional difficulties, which results in them being key players in cases of indiret discrimination. The distribution of territorial power and the situation of national minorities have been causes of different political problems.“Who am I? Where do I belong?” are questions asking for indentity. Some people argue these should be relevant issues when applying the criminal law, circle of moral incumbency to cover animals -non humans-, arguing that they of life that involves their survival as a whole.
