El V Informe del Observatorio de la Justicia Gratuita CGAE-LA LEY correspondiente al año 2010 ha logrado consolidarse en el mundo jurídico como un elemento esencial para obtener un conocimiento fidedigno de la Asistencia Jurídica Gratuita y el Turno de Oficio en España sobre la base de la experiencia de los cuatro estudios anteriores y la homogeneización de los datos aportados por los 83 Colegios de Abogados. Sin duda, el dato más relevante es el freno de la inversión de las Administraciones Públicas en la gestión de este servicio. Se ha roto la tendencia al crecimiento que se venía produciendo en años anteriores con una disminución en un 4% en los costes de este servicio público esencial para la defensa jurídica de las personas y que en 2010 prestó asistencia a casi un millón setecientas mil personas, con un coste de 154 euros por ciudadano atendido. Aunque los anteriores sondeos del Turno de Oficio ya evidenciaban un servicio claramente evaluado de forma positiva, los datos del V Informe mejoran la valoración que dan los ciudadanos a los abogados que prestan el servicio de Justicia Gratuita alcanzando una puntuación de 6.9 en la actualidad frente a los 6.4 en 2010. Por su parte, el servicio de Expediente Electrónico, insuficientemente conocido por los usuarios y con el que se han tramitado 200.000 expedientes, encuentra una acogida muy favorable entre sus usuarios, que lo puntúan con un 8.5. Las Recomendaciones y Sugerencias de cambio que realizan el Grupo de Expertos se convierten en el elemento más importante del V Informe, máxime cuando no sólo participan representantes de todos los operadores jurídicos relacionados con la Justicia Gratuita y el Turno de Oficio, sino que la mayoría de sus miembros por decisión del Consejo General de la Abogacía Española no son abogados, incluyendo a consumidores y usuarios en este Grupo de Expertos.

Reconociendo la legitimidad de este gobierno para desarrollar la política educativa que le garantiza su mayoría parlamentaria, no queremos dejar pasar este momento sin dar respuesta al citado proyecto, analizando las consecuencias que va a tener para la educación, pues se trata de una reforma que altera sustancialmente las bases de las educación que se ha venido construyendo, que socava la importancia que tiene la educación pública para una sociedad integradora y que presenta una serie de medidas que, pretendidamente, están dirigidas a la mejora de la calidad de la educación, cuando algunas de ellas van a deteriorarla en realidad. Como profesionales de la educación queremos hacer públicas algunas consideraciones, aportar datos y argumentos, así como señalar vías para abordar soluciones a problemas que sobrepasan el ámbito de la acción de los gobiernos y que han de proyectarse a medio y largo plazo.
